한국의 독도 영유권 유지·강화를 위해서는 독도에 대한 실효적 지배를 공고히 하는 일이 필요하다. 국제법상 실효적 지배의 주체는 원칙적으로 국가(기관)이다. 따라서 민간인 활동은 그 자체만으로는 국가행위가 아니며, 국가의 실효적 지배를 뒷받침할 수 없다. 하지만 사인이 사전에 국가의 위임을 받아 행동하거나 국가가 사후에 사인의 활동을 승인, 채택하거나 또는 민간인들이 공권력 부재 시에 영토 수호를 위해 자발적으로 행동에 나설 경우, 그러한 행위는 국가의 행위로 간주, 귀속될 수 있다. 이 경우 영토의 실효적 지배를 뒷받침하는 중요한 증거로 원용될 수도 있다. 이런 맥락에서 1953년 4월 홍순칠 주도의 독도의용수비대 조직과 1956년 12월까지 독도에서의 활동, 그리고 최종덕의 22년간 독도 거주 및 관련 행적은 한국의 독도 지배를 공고히 하는데 결정적으로 중요한 역할을 했다고 볼 수 있다.In order to maintain and intensify the territorial Sovereignty of the ROK over Dokdo, it is quite necessary to make its effective control of the island more solid. Under international law, the subject of effective control is in principle an organ of a state. In consequence, civilian activities themselves cannot constitute an act of a state and back up effective control of its territory. In spite of this logic, if a private person or group of persons acts by the power conferred upon in advance by his or their state, or if a state acknowledges and adopts the conduct in question as its own, or if a person or group of persons is in fact exercising elements of the governmental authority in the absence or default of the official authorities, and in circumstances such as to call for the exercise of those elements of authority, such a conduct can be regarded as an act of the state and also attributable to it. Especially, this is true with private individuals' acts for defending their national territory which is in the present danger of military or para-military attack or intrusion by a foreign state. Furthermore, peaceful and continuous domination of more than one civilian, including habitation and diverse activities on an island, upon the support or recognition of his state can be a good evidence for effective control of the territory. In this context, the constitution of Dokdo Defending Volunteers Group under the leadership of Hong Sunchil in 1953 and its territory defending activities on Dokdo for 3 years and Choi Jongduk's habitation and his relevant activities to cultivate an environment for a sustainable life on Dokdo for 22 years made a great contribution to consoldating effective control of the ROK on that island.
