2011년 7월 1일부터 기업단위 복수노조가 허용되면서 노조설립 및 조합원 수 증가, 단체교섭, 쟁의행위, 노사관계 성격 변화 등 한국의 노사관계 지형 전체에 새로운 변화가 시작되고 있다. 본 연구에서는 한국의 노사관계 관행과 법제도적인 환경에서 기업단위 복수노조 허용이 노사관계에 어떤 영향을 미칠 것인지에 대해 분석하였다. 이를 위해 영국·일본·캐나다 등 외국의 노사관계 환경에서 복수노조와 노사관계의 상호관계를 분석하고, 복수노조가 단체교섭, 파업 등 노사관계에 어떠한 영향을 미치는지를 분석하였다. 이러한 선행연구를 배경으로 한국의 노사관계 환경 및 제도적 특성하에서 복수노조 허용이 노사관계에 미칠 영향을 분석하였다. 이를 위하여 2010년 206개 사업장의 노사관계 당사자들을 대상으로 실태조사를 실시하여 복수노조가 설립될 가능성이 높 사업장 노사관계 특성과 복수노조 설립이 단체교섭, 파업, 노사관계 성격 변화에 미칠 영향을 실증분석하였다. 또한 2011년 7월 1일 복수노조 법시행 시부터 10월 31일까지의 복수노조 설립 및 특성에 대한 실태조사 결과를 종합하여 복수노조 제도가 노사관계에 미칠 영향을 분석하였다. 실증분석 결과, 현재 노조가 설립되어 있는 사업장에서 2011년 7월부터 2012년까지 복수노조 설립 가능성은 7∼14% 정도 되는 것으로 분석되고 있다. 이러한 복수노조 설립 양상은 기존 노조가 분할되어 복수노조가 설립되는 ‘분할노조형’이 48%나 돼 실제 노조 조직률 증가폭은 노조 숫자 증가만큼 크지는 않을 것으로 조사되었다. 이번 실증분석에서 복수노조 설립 가능성이 높은 사업장은 종업원 규모가 크거나, 미조직 직종이 많은 사업장인 것으로 조사되었다. 또한 노사관계가 적인 사업장, 노동조합 리더십이 취약한 사업장에서 복수노조 설립 가능성이 높은 것으로 조사되었다. 복수노조 설립 시 단체교섭 방식은 대부분 교섭창구를 단일화하여 진행하는 것으로 조사되었다. 또한 복수노조 설립 시 사업장 노사관계는 불안정해지고 파업 발생 가능성은 약간 증가할 것으로 조사되었다. 그러나 장기적으로 노사간 세력관계는 사용자가 우세해지는 방향으로 변화할 것으로 조사되었다.The legalization of plural unions at the workplace level starting July 1, 2010 has affected a number of changes in the labor-management relations landscape of Korea, such as an increase in the number of unions and membership, altering nature of labor-management relations, emergence of labor disputes and changing dynamics between labor and management. This study analyzes the potential impact of union pluralism on labor-management relations in the context of Korea's existing labor- management practices and legal environment. For comparison's purpose, it analyzes the relations in workplaces with plural unions in other countries such as the UK, Japan, and Canada, as well as the impact on collective bargaining and strikes. Based on such literature review, it analyzes the potential impact that might be wrought given the labor-management environment and institutions of Korea today. A status survey was conducted on the interest parties in 206 workplaces and an empirical analysis was undertaken to understand the relational characteristics at workplaces with high likelihood of plural unions, and to look forward to the possible impact of such union pluralism on collective bargaining, strikes and changes in the nature of the relations. The empirical analysis results in 7-14% of workplaces with an existing union having plural unions between July 2011 and 2012. However, given that 48% of new unionization appears to result from a “split” (where one existing union is split into several), the increase in actual organization rate is not likely to be in direct proportion to the increase in the number of unions. The empirical analysis also showed that the workplaces that are likely to see plural unions tend to be large in size, low in organization rate or not organized at all. It was also found that where the union leadership is not strong or labor-management relations are confrontational, it is likely to lead to plural unions. With the presence of plural unions, 86% said they would try to unify the collective bargaining channel. Most of the collective bargaining is expected to take place at the workplace level, possibly spelling trouble in the sectors (metal, hospitals, financial industry) where industrial bargaining has been the norm. Analysis of the possible impact points to destabilization in labor-management relations and a slight increase in the likelihood of a strike. But for the long term, it was found that the relations at the workplace level will become more cooperative and the dynamics will tilt in favor of the employer.
