이 연구는 교원능력개발평가와 관련된 쟁점을 분석하고 그에 따르는 과제를 제시하기 위하여 시도된 것이다. 이를 위해 교원능력개발평가가 등장하게 된 교육계 내외의 배경 및 정책 추진 전개과정에 대한 진단을 기초로, 교원능력개발평가의 목적, 대상, 주체, 주기, 관리위원회, 결과의 활용, 위임사항 관련 규정의 의미를 해석하고 문제점을 분석했다. 이 제도는 공교육 신뢰회복 차원의 교원 전문성 신장을 내걸고 우수⋅미흡⋅부적격 교원 문제 해결책으로 추진되었으나 능력진단 연수에 머물렀다. 대통령령 수준의 법제화에 머문 한계를 보였으나 제도를 안정화 시켰고 쟁점을 반영한 평가의 원칙은 제도화의 방향을 나름대로 제시하였다. 그러나 자율적이며 실효적인 제도 정착을 위하여 과도한 위임입법보다는 교육과학기술부, 시⋅도교육청, 단위학교 간의 체계적인 역할분담이 요구되며, 무엇보다 근무평정제도를 포함한 교원인사 제도 전반과 연동시켜야할 개선 과제를 남겼다.The purpose of this study is to analyze the issues of the teacher appraisal for professional development(hereinafter referred to as TAPD) in legislation and propose the it's tasks. This article is consisted of five chapter; Preface, The introduction of the policy background and evolution, An analysis of regulatory related to TAPD, Issues from the TAPD in legislation, and Conclusion.
The Ministry of Education, Science and Technology(MEST) expanded the TAPD to all schools nationwide in March 2010, and offered customized training programs for teachers upon evaluation results. The TAPD's direct legal basis is based on the Provisions for training of teachers(§18~§23). It prescribe the aims, target, method, principle, items, notification of results, and the management committee on TAPD.
The issues from the TAPD in legislation can be summarized as four points below. First, the need for a legal basis(Legislation & Improvement of conditions of education), Second, the scope of delegated legislation(Presidential Decree & Ordinance of the MEST & Rules of Superintendent). Third, aims and utilization of results(Professional development & Personnel evaluation). And fourth, the principle of TAPD(Guidelines of Government & Autonomy of Schools).
As a conclusion, Firstly, it is necessary for us to establish the principle of role-division and cooperation among MEST, Superintendent, and School. Secondly, we should connect with the TAPD and the personnel management. Lastly, In order to guarantee the autonomy of schools as possible, we should reform the law related with TAPD.
