북한 체제의 누적된 문제점이나 권력투쟁으로 인해 최악의 경우 국가 시스템이 마비되는 상황이 발생할 수 있다. 이러한 상황에서 군사적 충돌 가능성이 있기에 합법적인 무력사용에 대한 폭넓은 검토가 필요하다. UN 헌장 제51조의 자위권을 비롯하여, 국제관습법상의 자위권, 초청에 의한 개입, 인도적 개입 등 다양한 권원에 대한 보다 심도 있는 논의가 필요하다. 한편, 북한지역에 적용 가능한 규범과 관련하여 불법단체에 의해 점유된 곳이므로 한국의 국내법이 적용될 수 있다는 주장과 그렇지 못하다는 주장으로 나뉘고 있다. 전자는 헌법 3조의 영토조항과 일부 UN 결의 내용이 한국의 주도권을 인정하고 있다는 주장을 펴고 있다. 그러나 남북이 UN에 동시 가입한 이후 이러한 주장의 설득력은 점차 약해지고 있다. 다만 남북이 「기본합의서」에서 합의한 ‘통일을 지향하는 과정에서 형성된 잠정적 특수관계’는 북한지역에 한국의 우선권이 있다는 가장 설득력 있는 근거가 될 것이다. 따라서 북한에 위기상황이 발생하고 주변국들이 군사적으로 개입하게 될 경우 한국 정부는 남북간의 특수관계 논리를 기반으로 한반도 통일을 이끌어 내는 지혜가 필요하다. 끝으로 북한 위기상황의 전개 양상에 따라 대량탈북사태가 벌어질 수 있다. 이 경우 주변국으로의 탈북난민 문제는 국제법상 난민의 지위에 관한 규범들이 적용될 것이다. 그 결과 중국이나 러시아에서 탈북난민을 국제법상 난민으로 인정할 것인가가 핵심 관건이 될 것이다. 정부의 사전 준비와 협조가 필요한 영역이다. 이와 반대로 한국으로 탈북난민이 유입될 경우 국내법에 따라 대한민국 국민으로서의 지위가 부여되므로 규범적 차원의 문제는 제기되지 않을 것이다. 다만 이 때 막대한 비용이 소요될 것이므로 경제적 차원의 대비가 필요하다.The accumulation of limiting and debilitating factors or a power struggle emanating from the North Korean system may paralyze it's political system or state functions. Under this contingency, international armed conflict can be caused, and thus comprehensive studies covering the legalities are necessary. Although covering every legal corner of North Korea's contingency issue is difficult, legal justification for the ROK led military intervention should be well established for the reunification of the Korean peninsula as a preparation of foreign military intervention into the North. If not, the ROK might loose its chance to reunify the peninsula even after the North Korea's state collapse.
On the other hand there is a debate within the Korean legal society wether the ROK can apply its domestic law up to the nothern part of the Korean peninsula. Many say that, since the ROK is the only lawful political authority in the peninsula, based upon the UN resolution, its domestic law can be applied. This view is supported by the ROK's constitution, which stipulates that “the territory of the ROK includes the Korean peninsula and its affiliated islands.” However, from the perspective of international law, there has been different voice on it. Both South and the North have yet to express intentions of official cross-recognition. Instead, both sides have signed on to the inter-Korean basic agreement, viewing South-North relations as that of a special internal relationship within one ethnic group and as that of interim in a way to reunification. These reasoning would be the best reasoning for the ROK to argue its superiority to other countries during the contingency of the North.
Lastly, one of the most sensitive issues related to the contingency of North Korea scenarios is the matter of a massive influx of North Korean refugees into neighboring states. Predictions place the possible refugee numbers at thens of thousands at minimum. Thus, laws relating to refugee must be speculated. Under international law, the recipient state of refugee has the right to refuse entry. Thus, the ROK has to maintain close relation with its neighboring state to persuade them to protect North Korean refugee. In addition, the ROK must prepare its domestic assets to cover refugee influx during the contingency because, under the ROK's domestic law, North Korean refugee are regarded as ROK nationals. With these preparations, the ROK can abide rule of law during the time of extreme challenge.
