이 글에서는 민간기업이 수용의 주체가 되어 수용권을 행사할 수 있는지 및 어떠한 조건 하에서 그러한 수용이 정당화될 수 있는지에 관한 헌법재판소 결정(헌법재판소 2009. 9. 24. 선고 2007헌바114 결정)을 평석하였다. 민간기업에 수용권을 부여하고 있는 산업입지법의 위헌성 여부가 쟁점이 되었는바, 다수의견은 합헌으로 판단한 반면, 소수의견은 위헌으로 판단하였다.
다수의견과 소수의견은 ① 민간기업도 수용의 주체가 될 수 있다는 점, ② 영리추구 활동의 결과 경제발전에 기여하게 되는 경우도 수용의 공공필요성을 충족시킬 수 있다는 점, ③ 그러한 수용의 경우 공익성 담보장치가 필요하다는 점에 대해서는 뜻을 같이 한다. 그러나 민간기업의 영리추구활동을 통해 달성되는 공익의 가치와 토지소유자의 재산권의 가치에 대해, 법정의견은 전자에, 소수의견은 후자에, 더 높은 가치를 두고 있다. 그 결과 소수의견은 공익성을 담보하기 위한 법적 장치를 더욱 엄격하게 요구하였고, 산업입지법에는 그러한 장치가 부족하다는 판단을 하게 된 것이다. 필자는 아래와 같은 점에서 다수의견의 논증에 의문을 제기하였다.
첫째, 다수의견에서 공익성 담보장치로 열거하고 있는 제도 중 상당 부분은 통상의 개발사업이나 공용수용에도 적용되는 제도로서 민간기업을 위한 수용에 특유하게 적용되는 강화된 입법적 장치라고 보기는 어렵다. 민간기업의 수용을 허용하는 유사한 성격의 법률인 ‘기업도시개발 특별법’과 비교하여 보아도 산업입지법은 공익성 담보장치가 약하다.
둘째, 다수의견은 토지취득 요건을 수용의 합헌성 판단과는 무관한 것으로 보고 있다. 그러나 토지취득 요건은 수용을 하는 민간기업과 수용을 당하는 토지소유자 사이의 이해관계를 조정하는 기능을 수행하고 있다. 또한 토지취득 요건이 없어 토지소유자 측에서 가격결정에 관한 협상력을 발휘할 여지가 전혀 없다는 것이 실제 이 사건 분쟁이 발생하게 된 중요한 원인이기도 하다. 그러므로 토지취득 요건의 문제를 침해의 최소성 판단 과정에서 고려한 소수의견의 입장이 보다 타당한 것으로 보인다.This article discuss the case(the Constitutional Court 2009. 9. 24. 2007heonba114 decision) where the Constitutional Court decided whether or not a private enterprise can exercise the right of compulsory purchase as a principal agent, and on which terms such a compulsory purchase can be justified. The dispute on constitutionality arose with regard to the Industry Location Act which grants the private enterprise the right of compulsory purchase. The Constitutional Court found it constitutional by majority. The majority opinion and the dissentient opinion fall together in that the private enterprise can act as a principal agent of compulsory purchase, profit-seeking activities contributing to economic development may satisfy the requisite of public need of compulsory purchase, and such a compulsory purchase require devices securing public interests. However, There is a disagreement on which one should be put first between the value of public interests achieved by private enterprises’ profit-making activities and the value of land ownership. The majority view prefers the former, while the dissentient one does the latter with the result that it points out the lack of stricter legal tools guaranteeing public interests in the Industry Location Act.
However, the majority opinion may be subject to the following limitations.
First, it is difficult to consider a substantial part of the devices which the majority opinion thinks secure public interests as applicable especially to private enterprises’ compulsory purchase. It is because those apply also to usual development planings or compulsory purchases. The devices securing public interests in the Industry Location Act seems less sufficient in comparison with the Special Act on Enterprise City Development which in fact allows private enterprises’ compulsory purchase. Second, the majority opinion takes the view that the requisite of acquiring land is irrelevant to judging the constitutionality of compulsory purchase. However, such a requisite play the role of striking a balance of interests between the private enterprises of compulsory purchase and land owners. Furthermore, the case was caused mainly by the lack of the requisite with the result that land owners had no room at all for negotiating prices. Therefore, the dissentient opinion should be more preferable in that it pays a special regard to the requisite in considering the test of minimum infringement.
