헌법재판소는 형법상 간통죄에 대해 4차례에 걸쳐 합헌결정을 하였으며, 혼인빙자간음죄에 대해서도 합헌결정을 하였다가 위헌으로 변경하였다. 성적 자기결정권은 개인의 내밀한 사적 영역에 속하면서도 그가 속한 공동체의 사회문화와 밀접하게 관련되어 있어서 개인적 가치와 공동체의 가치가 충돌되는 경계지점에 놓여 있다. 헌법재판소가 간통죄와 혼인빙자간음죄에 대한 위헌심판에서 성적 자기결정권에 대해 판단하였으나 성적 자기결정권의 개념, 법적 성격, 위헌심사기준 등이 명확하게 규명된 것이 아니다. 헌법재판소의 성적 자기결정권에 대한 헌법적 판단과 관련하여 다음과 같은 결론을 제시하고자 한다.
첫째, 성적 자기결정권은 독자적인 헌법상 기본권으로 인정할 필요가 없다. 성행위의 여부 및 그 상대방을 결정할 수 있는 권리는 헌법 제17조의 사생활의 비밀과 자유의 보호영역에 포함된다.
둘째, 성적 자기결정권에 대한 위헌심사기준은 과잉금지의 원칙이 적용될 것인데, 그 구체적인 심사강도는 개인의 핵심적 자유영역에 해당하므로 이를 제한하는 경우에는 엄격한 비례심사기준을 적용하여야 한다.
셋째, 간통죄에 있어서 성적 자기결정권에 대한 위헌심사기준으로 엄격한 비례심사기준이 적용된다고 하더라도 그것이 곧바로 위헌결정으로 귀결되는 것은 아니라고 하겠다.
그러나 성적 자기결정권에 관한 법현실의 변화를 고려할 때 간통죄를 폐지하는 것이 타당하다고 생각한다.
넷째, 간통죄가 폐지되고, 혼인빙자간음죄가 무효화되었다고 하더라도 이것을 곧바로 간통과 혼인빙자간음이 도덕적으로나 법률적으로 허용된다는 것은 아니다. 혼인빙자간음행위는 그에 대한 도덕적 또는 민사적 책임으로부터 면제되는 것이 아니므로 간통배우자나 혼인빙자간음행위자는 이혼, 재산분할, 위자료 등의 손배해상 등 민사적 책임을 져야 한다.The Constitutional Court has determined that the crime of adultery was consistent with the constitution for four times. Concerning the crime of sexual intercourse under pretence of marriage, the Court changed its prior position and invalidated the statute. Self determination of sexual intercourse not only lies within the private sphere of an individual’s privacy, but it is also intertwined with the social culture of a community where the individual belong to. Hence, it lies within the grey area where personal values conflict with community values. Despite numerous constitutional decisions, the concept of self determination of sexual intercourse, and its protected scope have not been clearly defined. I would like to propose the following conclusion on the constitutional decision of the self determination of sexual intercourse First, there is no need to recognize the self determination of sexual intercourse as one of Constitutional Law's basic natural rights. The right to engage in a sexual relationship and to choose one's own partner is already included in article 17 of the Constitution protecting one's freedom of privacy.
Second, the principle of balancing test is to be applied when deciding the standard of the constitutional review of the self determination of sexual intercourse, yet since the specifics of the evaluation is directly relevant to the individual's essentially protected freedom, applying at the same time a strict scrutiny of proportionality.
Third, even if a strict proportional judgment were said to be applied regarding the self determination of sexual intercourse relevant to the adultery act, this does not immediately result to the unconstitutionality of the relevant act.
However, in light of the changing legal reality concerning the self determination of sexual intercourse, it is most appropriate to abolish the adultery act.
Fourth, even if the adultery act were to be abolished, and the crime of sexual intercourse under the pretense of marriage were to be invalidated, this would not mean that both acts are to be ethically nor legally permitted.
