지난해 반값등록금 문제·해고 근로자 돕기 등 각종 사회현상에 대해 자신의 의견을 적극적으로 피력하는 연예인, 이른바 ‘소셜테이너(socialtainer)’에 대해 방송사가 고정출연을 금지하는 일이 벌어졌고, 이는 곧장 ‘표현의 자유’의 침해와 관련된 논쟁으로 이어져 정치적 쟁점으로까지 부각되었다. 방송사의 소셜테이너에 대한 고정출연 금지를 기본권의 효력과 관련해 단순히 사적인 문제로 치부할 수 없다는 점 등에서 헌법적 해석과 판단이 요구된다. 판단이 요구되는 헌법적 쟁점은 다양하다. 우선, 방송사업자가 사규(社規)를 통해 소셜테이너의 고정출연 중단 내지 고정출연을 금지하는 행위에 대해 소셜테이너가 기본권 침해를 주장할 수 있는지, 있다면 그 헌법적 내지 헌법이론적 논거는 무엇인지이다. 또한, 기본권 효력을 주장한다면 그 구체적인 기본권의 내용은 무엇인지, 과연 기존의 논의에서와 같이 ‘표현의 자유’인지 아니면 ‘직업의 자유’ 등 다른 기본권인지에 대한 논증도 요구된다.
왜냐하면, 기본권 침해여부에 관한 헌법적 정당성 심사에서 기본권에 의해 보호되는 생활영역 즉, 보호영역을 파악하는 것이 기본권 심사의 핵심을 이루기 때문이다. 아울러, ‘방송사 내지 방송조직의 성격’에 관한 해석론에 따라서는 ‘제작권 보호’ 측면에서 소셜테이너의 고정출연 금지 내지 중단이 정당화된다고 할지라도 그 형식이 경영진에 의한 독자적인 결정을 통해서도 정당화될 수 있는 것인지 아니면 별도의 수단을 통해야만 정당화될 수 있는가라는 문제도 제기된다. 이와 같은 이론적 탐색은 결국 소셜테이너의 고정출연 금지행위에 관한 기존 담론에 있어서 전향적인 인식전환의 당위성과 필요성을 논증함으로써 현재 우리 사회에서 겪고 있는 또 향후에 되풀이 될 수 있는 소셜테이너의 고정출연 금지행위라는 문제를 둘러싼 갈등과 논쟁을 해결 내지 예방할 수 있는 방안을 시론적(試論的)으로 제시함에 궁극적인 목적이 있다.On July 13, 2011, Munhwa Broadcasting Corporation(MBC) revised a company regulation. The Amendment was aimed to prohibit the casting Socialtainer as regular. The promulgation of the new clause is for that cast should maintain a position of impartiality in every social issue. But Socialtainers contend that the regulation excessively infringe Socialtainer's fundamental right of speech.
This article seek to review the constitutionality of MBC regulation. First of all, it examines whether the state action doctrine is a valid reason for supporting the Socialtainer's claim or not. Under state action doctrine, Private parties are subject to the Constitution when they are performing public functions or sufficiently entangled with the government through funding or regulation.
Contrary to dominant viewpoint that two constitutional values, editorial independence of broadcasting companies and Socialtainer's fundamental right of speech, collide in this case, I suggest that we should focus on how to understand the legal Characteristics of casting Socialtainer as regular. This article also contemplates the limit of principle of private autonomy concerned with state obligation to protect the fundamental rights. The article concludes with the suggesting the new solutions based on the Constitutional law about how to regulate the juristic relation between a broadcasting company and cast.
