For the long-term advancement of tourism by establishing a consistent tourism policy to match the times, this study aimed to deduce the problems in Korea tourism basic act through a comparative analysis of the tourism laws in Korea and Japan(Act concerning the Pursuit of an Established Tourism Country). As a result of comparing the tourism laws of both countries, it is shown that Korean tourism laws have no segmented, detailed specifications in overall content so that the role of the Tourism Promotion Act is unclear and fails to reflect changes over time. Also, it was discovered that the role of tourism development plans was unsatisfactory as the cooperative system with other departments and objectives according to each clause were vague. To solve these problems, structural improvement solutions should be prepared. The law should be amended also in consideration of its contents as well as structural improvement solutions.
