우리나라 사회가 다문화사회화함에 따라 사회통합의 문제가 중요한 국가적 과제로 대두되었다. 헌법학의 관점에서도 사회통합의 과제를 수행하기 위하여 국민 개념을 재검토할 필요가 있다. 이를 위하여 기존의 국민과 외국인에 관한 이론으로 1) 국민과 외국인의 헌법적 지위, 2) 외국인의 기본권 주체성, 3) 국민 개념과 국민의 인접 개념의 순으로 이 주제를 검토해 보았다. 그 결과 기존의 국민과 외국인의 헌법상 지위론은 사회통합의 관점에서 불만족스럽고, 외국인의 기본권 주체성의 확대론도 사회통합에 기여하는데 부족함이 있었다.
따라서 국민 개념과 인접 개념인 민족, 인민, 시민 등의 개념을 재검토하였다. 민족 개념은 사회통합에 역행하고, 인민 개념은 오히려 또다른 사회갈등을 일으킬 수 있으므로 바람직하지 않다. 미국과 프랑스헌법에서 사용되고 있 시민 개념은 우리나라에서는 사회과학계에서 널리 논의되고 있으나 법학에서는 사용되지 않는 개념이다. 이 연구에서는 이 개념을 우리나라에 영주권을 가지고 있는 외국인을 포함하는 개념으로 법적으로 받아들여 한국시민이라는 개념을 국민 개념을 보완하는 개념으로 사용할 것을 제시하였다. 국민과 외국인을 포괄하는 한국 시민 개념을 받아들이면 구별되어온 국민과 외국인을 동질성 있는 하나의 새 개념으로 포섭할 수 있어 사회통합에 기여할 수 있으며, 동태적·능동적 시민 개념을 통하여 참여민주주의의 실현이라는 헌법적 가치를 실현하는데도 기여할 수 있을 것이다.As Korean society becomes multi-cultural society, social integration becomes an important national problem for the Government to solve. From a constitutional point of view, a concept of nation should be reviewed to solve the social integration problem.
This study reviews 3 theories; 1) a theory of constitutional status of nation and alien, 2) a theory of subject of constitutional rights of alien, and 3) the concept of nation and adjacent concepts.
A theory of constitutional status of nation and alien is dissatisfactory for social integration, and a theory of subject of constitutional rights of alien is not sufficient either.
This study reviews a concept of nation and its adjacent concepts, that are nation(another concept), people and citizen. A concept of nation as a community of historical destiny is against social integration, and a concept of people is not desirable because this concept can give rise to new ideological conflict.
A concept of citizen(citoyen) is a legal term that the American and the French Constitutions use, and is a concept used widely in the social scientific society but not in the legal society of Korea.
This study suggests to use a concept of citizen as a complementary concept of nation that include nation and aliens who have a permanent residentship. This new concept can be contributable not only to social integration, but also to realize another constitutional value of participatory democracy through a concept of dynamic and active citizen.
