환경갈등의 예방 또는 해소를 위해 환경법이 할 수 있는 역할은 무엇인가? 환경갈등을 통해 환경문제가 드러나서 적절히 대응될 수 있도록 환경갈등을 행정절차 또는 각종 소송 등 공식적인 법적 논의의 장으로 수용할 필요가 있고, 환경갈등이 합리적 의사결정을 왜곡하지 못하도록 의사결정의 실체적, 절차적 기준과 조직 등을 법제화할 필요가 있다. 환경법의 임무는 환경갈등의 예방 또는 해소를 직접적인 목표로 하기 보다는 환경과 관련된 사적, 공적 의사결정이 합리적으로 이루어지도록 함으로써 간접적, 장기적으로 환경갈등을 예방, 해결하는 것이 되어야 한다.
그러나 법이 추구하는 합리성은 사회상 및 국가의 역할의 변화와 더불어 변천하는데, 그 변화의 방향은 형식적 합리성에서 실체적 합리성으로, 실체적 합리성에서 다시 반성적 합리성으로 나아가고 있다는 이론이 우리 법의 변화에 대해서도 적용된다. 우리 환경법에서도 환경이익의 침해를 주로 민사소송에 의존하여 해결하였던 형식적 법의 시기에서 국가가 법을 통해 환경보호의 가치를 구현하고자 적극적으로 규제체계를 만든 실체적 법의 시기를 거치면서, 이제 환경이익과 상충되는 다른 이익이나 가치들과의 관계에서 이를 조정하고 선택함에 있어서 국가가 일방적으로 목표를 정하고 강제하는 것이 아니라 각 행위자들에게 자율성을 부여하고 상호 협력하고 견제할 수 있도록 구조를 부여하는 역할을 담당하는 것이다. 이 경우 법은 반복적으로 이루어지는 사회통합과정에 구조를 부여하는 조직과 절차를 주로 규율한다.
각 단계의 법이 추구하는 합리성이 충분히 구현되지 못하였을 경우 환경갈등의 원인이 될 수 있다. 환경이익에 대한 구체적인 법적 권리화가 충분하지 못할 경우 법적 절차에 의해 해결될 분쟁이 환경갈등으로 발전될 수 있다. 환경적 쟁점이 포함된 행정계획절차에서 계획형량이 적정하게 이루어질 것이 담보되지 못하거나, 환경영향평가가 충실히 이루어지지 못한 경우에도 환경갈등의 원인이 될 수 있다. 따라서 환경갈등과 관련하여 환경법의 임무는 이러한 환경이익의 법적 권리화의 진전, 계획확정절차 및 환경영향절차가 반성적 절차로 이용될 수 있도독 이를 정비하는 것이다. 이를 위해서는 환경계획이나 환경영향평가에 대한 사법심사의 강화 및 적정화 또한 필요하다.What is the role of the environmental ‘law’ to prevent or solve the social conflicts around environmental issues? Legal system can invite the environmental issues which are revealed through the social conflicts to the formal institutional fora such as administrative process or civil or administrative lawsuits and at the same time design reasonable public decision-making process lest environmental conflicts distort the quality of decision-making. In that, the task of environmental law should not be to directly suppress or resolve the conflicts, but be to establish institutional conditions to steering reasonable private and public decision-making to prevent undesirable developments of social conflicts indirectly and in the long run.
The legal rationality has taken different mode depending on the changes of society and the goal of states. The persuasive theoretical model of such a change was suggested by Teubner as ‘formal rationality → substantive rationality → reflexive rationality.’ It corresponds to the historical development of a state from the modern nation state to welfare state and beyond it. This model of transition can also explain the development of environmental law in Korea. Under the formal law period the civil tort law took the role of delimiting the autonomous sphere of an individual who can act with environmental effect. Pursuing environmental welfare state, the command and control regulation have been strengthened under the substantive law system. Facing the limit and inefficiency of command and control regulation the new legal approaches have been adopted such as ‘Pro-environment Mark System’, ‘voluntary agreement regulation’, ‘in-house environmental auditing system’. Under reflexive law the focus should be on the design of organization and procedure to stimulate social integration, not on the specific value and rules of action.
Failure in legal rationality can be a cause of environmental conflicts. For example, due to the failure to make environmental interests as statutory rights the infringed cannot go to legal forum to seek protection and the situation can be developed into environmental conflicts. When in the administrative planning procedure the interested are not given effective and efficient opportunities to participate in the decision-making process, the unsatisfaction with participation can be a cause of distrust and serious conflict. The quality of Environmental Impact Assessment is also important for improving the environmental decision-making and prevent conflicts.
