민주화이후 정책과정에서 의회의 역할이 증대되고 있다. 과거와 다르게 의원입법발의건수가 전체 발의 법안중에서 90%를 차지할 정도로 적극적인 정책의제와 형성과정에 참여하고 있다. 이에 따라서 정책형성시에 합리성보다는 정치성에 치중하는 경향이 발생하고 있다. 이러한 문제로 실제 의원입법발의 법안의 경우 가결률이 낮고, 통과된 법안도 통과기간에 긴 소요시간이 걸리고 있다고 주장된다. 최근 정책연구에서 시간의 중요성이 제기되고 있다. 본 논문에서는 이러한 문제의식하에 법안 발의라는 정책의 창이 열린 다음 실제 법안의 통과라는 정책이 결정되기 까지 의원발의법안에 걸린 소요시간에 영향을 미친 요인들이 무엇인가에 대한 탐색을 하였다. 특히 의원발의 법안의 경우 법안자체의 성격과 대상집단들의 성격, 그 관계들에 영향을 받을 것이라는 가정하에 Wilson의 규제정치이론과 Schneider and Ingram의 대상집단과 정책설계이론의 바탕으로 가설을 구성하여 음이항 회귀분석을 통해서 가설을 검증해 보았다. 그 결과 법률안의 통과기간에는 규제대상집단의 권력성이 높을수록 법률안 통과기간이 길었다. 이는 대상집단의 저항과 로비를 통해서 지연을 시켰다는 것을 알 수 있다. 더불어 법안으로부터 혜택을 받는 집단의 이미지가 좋은 경우 법안통과기간이 짧았다는 것을 알 수 있었다. 즉 본 연구결과를 통해서 의원입법의 정치적 창이 열린후 실제 정책형성까지의 기간에는 정치적요소가 많은 작용을 한다는 것을 알 수 있었고, 특히 의원입법의 경우 사전적 정책대상집단과의 사전협의와 사회적 합의과정이 적은 경우가 많아, 법안 발의후 그 통과까지 대상집단의 로비와 저항 등의 정치적 갈등이 발생하여 법안통과기간이 길어짐을 알 수 있었다.Members of the National Assembly have played an increasing role in policy process since democratization in Korea. The number of laws proposed by assembly members represents over 90% of total proposed laws and is greater than the number put forward by the government. Therefore, politics is a more influential factor than rational or economic perspective on enactment in policy-making. This causes a low rate of bill passage and a longer time to pass each bill. This study examines what factors affect the time required to enact a bill into law. We assumed that characteristics of the target policy group are important factors to policy adoption, based on Wilson's regulatory politics theory and Schneider and Ingram's social construction and policy design theory. We test this model using negative binomial regression. The results show that if target groups with strong political power will be regulated by the proposed bill, it takes longer for the bill to be passed, and it takes less time when the law benefits a target group with a positive socially constructed image. We found that bills proposed by a congressperson take longer to pass after the policy window opens than those proposed by the government because of political considerations and activities such as political bargaining, lobbying, and resisting.
