최근 우리나라의 독도에 대해 일본이 영유권을 주장하면서 이 문제를 국제사법재판소(ICJ)에 회부하자는 제안을 하였고, 우리 정부는 이를 거부하였다. 우리 정부가 동의하지 않는 한 독도문제가 국제사법재판소에서 다루어지지 않을 것이지만, UN의 주요 사법기관인 ICJ가 아닌 UN의 정치적 기관, 즉 총회나 안전보장이사회에서 독도문제가 다루어질 가능성은 존재한다. 예를 들어 UN총회나 안전보장이사회에서 독도문제를 다룰 가능성은 남아있다. 프랑스-마다가스카르간의 도서분쟁, 영국과 아르헨티나의 포클랜드섬 분쟁, 그리스와 터키간의 에게해 도서분쟁 등의 사례를 통해 볼 때 UN의 정치적 기관의 결정은 분쟁당사국을 법적으로 구속할 수 없었다. 그러나, UN의 정치적 기관의 결정이 법적 구속력을 가질 수 있는 두 가지 경우를 상정하여 볼 수 있다. 첫째는 UN안전보장이사회가 헌장 제7장상의 결의로서 구속력이 있는 결정(Decision)을 내리는 경우이다. 둘째는 UN총회가 민족자결권의 행사를 확인하는 결의를 채택하는 경우에는 그 결의가 법적 구속력을 가지게 된다. 우리나라, 서이리안, 기니-비사우, 동티모르, 벨리즈, 서부사하라, 나미비아의사례를 볼 때 UN의 정치적 기관의 결의는 특정영토 주민의 민족자결권의 행사와 결합된 경우에는 그 영토를 점유하고 있는 주민의 영유권을 확립시킬 수 있는 효력이 있다고 평가할 수 있다. 우리나라의 대처방안으로 첫째, 1954년 한미상호방위조약을 활용하여야 한다. 즉, 독도가 1954년 한미상호방위조약 제3조의 적용대상임을 명확히 밝히고 일본이 독도에 대한 무력위협이나 도발 시에 우리나라가 미국의 도움을 요청할 것임을 밝혀야 한다. 둘째, 우리나라가 국제형사재판소(ICC)규정의 침략범죄(crime of aggression)개정조항을 비준하여 일본의 독도에 대한 무력도발 가능성을 억지하여야 한다.Recently, Japan claimed its sovereignty over Dokdo which is a Korean island and suggested this matter should be settled by the International Court of Justice (ICJ), but the Republic of Korea (ROK) refused this suggestion. Without ROK’s consent, this matter cannot be dealt with by the ICJ. However, in addition to the ICJ which is the principal judicial organ of the UN, the political organ of the UN such as General Assembly and Security Council may deal with the Dokdo matter.
An island dispute between France and Madagascar, the Falkland dispute between the United Kingdom and Argentina and some island disputes between Turkey and Greece show that the decisions of the UN political organs could not bind parties to the dispute legally. However, there can be two situations under which the decisions of the UN political organs: first, when the Security Council makes decision under Chapter 7 of the UN Charter; second, when the General Assembly adopts a resolution which confirms certain territorial measures as a result of exercising the right of self-determination.
The cases of the Republic of Korea, West Irian, Guinea-Bissau, East Timor, Belize, Western Sahara and Namibia indicate that resolutions of the General Assembly play an important element in the consolidation of title over territory already in possession.
I suggest two measures as the response of the ROK against Japanese present and future possible provocations over Dokdo. First, ROK should use the 1954 Korea-US Mutual Defense Treaty. Namely, ROK should clearly indicate that the Article 3 of the Defense Treaty cover Dokdo and it will ask the help of the US if Japan attacks or provokes militarily against Dokdo. Second, ROK should ratify the Crime of Aggression amendment to the Rome Statute of the International Criminal Court in order to deter Japanese aggression against Dokdo.
