2012년 8월 27일 노다 일본총리는 일본이 위안부를 강제 동원한 증거가 없다고 주장하였다. 이러한 일본 지도자들의 언행은 우리나라 국민들의 분노를 사고 있다. 특히 이들의 언행이 이들 소수의 개인의 주장일 뿐만 아니라 일본내의 보수 우익세력의 견해를 대변하고 있다는 점에서 문제의 심각성이 더욱 크다고 할 수 있다. 이 글에서는 위안부 제도의 범죄성을 부정하는 일본의 지도자들의 언행과 보수 우익세력의 행태가 국제형사재판소(International Criminal Court, ICC) 규정 제7조상의 강제실종에 의한 인도에 반한 죄(Crime against Humanity of Enforced Disappearance of Persons)를 구성할 수 있다는 점을 지적한다.
위의 ICC 규정과 범죄구성요건의 제1요건 (a)와 (b)를 종합하면 강제실종범죄를 구성할 수 있는 행위, 즉, 범죄의 물적 요건은 크게 두 가지로 나누어 진다. 첫째, 피해자를 체포, 구금 또는 유괴하는 행위로서 강제실종행위를 범할 수 있다(제1단계). 또는 둘째, 체포, 구금 또는 유괴 행위자체를 부인하거나, 피해자의 운명이나 소재에 대한 정보의 제공을 거절하는 것(제2단계)만으로도 강제실종행위를 범하는 것이다. 즉, 위의 둘 중의 하나를 범하면 강제실종범죄를 구성할 수 있다.
일본 지도자들의 최근 행위는 위의 두 번째 행위에 의한 강제실종범죄라고 할 수 있다. 강제실종범죄를 구성하는 두 가지 행위의 유형 중에서 첫 번째 행위, 즉, 체포, 감금, 유괴 등은 2차 대전 부근에 이루어졌으나, 두 번째 행위, 즉, 감금, 유괴행위 등을 부인하거나, 피해자의 운명과 소재에 대한 정보의 제공을 거절하는 행위는 현재까지 계속되고 있기 때문에 강제실종범죄는 현재도 계속되는 계속범의 성격을 가지고 있다고 할 수 있다.
일본지도자의 언행과 보수 우익세력의 위안부의 강제성을 부인하는 행태는 ICC규정 제7조 2항의 “민간인 주민에 대한 공격”을 구성하고, 그 공격이 ICC 규정이 일본에 적용되는 2007년 10월 1일 이후에도 발생하였기 때문에 ICC가 일본지도자의 언행에 대해 강제실종범죄로서 관할권을 행사하는 경우에는, ICC의 시간적 관할권이 충족된다고 할 수 있다.On August 27, 2012, Japanese Prime Minister Noda claimed that there is no evidence that Japan forcefully recruited “comfort women” (sex slaves). Similar remarks and behaviors of the Japanese leaders anger South Korean peoples. In particular, this situation has serious consequences in that their behaviors do not only represent their individual thoughts but also the opinions of Japanese conservatives. This article points out the Japanese leaders’ denial of the criminality of the system of comfort women and such behaviors of Japanese conservatives may constitute crimes against humanity of enforced disappearance of persons under Article 7 of the Statute of the International Criminal Court (ICC Statute).
The ICC Statute and Elements of Crimes provide the material elements of the enforced disappearance in two stages. First, the perpetrator can commit enforced disappearance by arresting, detaining or abducting one or more person (first stage). Second, the perpetrator can commit the crime by refusing to acknowledging the arrest, detention or abduction, or to give information on the fate or whereabouts of such person or persons (second stage). Namely, the perpetrator may commit the crime by doing one of the two stages.
The recent behaviors of Japanese leaders may constitute the second stage of enforced disappearance of person. Even though the first stage of enforced disappearance such as arresting, detaining and abducting committed around the second world war, the second stage of enforced disappearance has continued to be committed by Japanese leaders until now. Thus, the crime against humanity of enforced disappearance is a “continuous crime”.
The denials of criminality of comfort women by Japanese leaders and conservatives constitute “a widespread or systematic attack directed against a civilian population”(namely, attack against South Korean people and the victims of Japanese sexual slavery) and the attack occurred after October 1, 2007 on which the ICC Statute entered into force for Japan, the ICC has the jurisdiction ratione temporis over the present Japanese leaders including Prime Minister Noda on the account of crime against humanity of enforced disappearance of person under Article 7 of the ICC Statute.
