가정폭력으로 인해 남편을 살해한 여성의 사례는 가정폭력이 야기한 가장 비극적인 결과라고 할 수 있는데 2000년 이후의 국내 판례에서 학대로 인해 남편을 살해한 여성을 변론하기 위해 매맞는 여성 증후군(Battered Woman Syndrome, BWS)이 종종 등장하게 되었다. 이 이론이 생산된 미국의 학계와 법원에서는 과학적 증거로서의 증후군이 가지는 가치에 관한 논의가 끊임없이 지속되어 왔지만 국내에는 이에 관한 학문적 논의가 충분히 진척되지 못한 상태에서 법적 증거로 사용되어진 것이다.
본 고는 가정폭력으로 인해 남편을 살해하고 복역 중인 16명의 여성들을 대상으로 심층면접을 실시하였다. 그 결과 여성들은 Walker의 이론과 같이 학습된 무기력에 의해 학대상황을 탈출하지 못한 것이 아니라 남편의 보복이나 이혼 이후의 생활에 대한 두려움, 자녀의 안전에 대한 걱정 때문에 남편을 떠나지 못한 것으로 나타났다. 실제 여성들은 경찰이나 주변인들에게 도움을 청했음에도 적절한 도움을 받지 못했다. 또한 누적된 폭력이 어느 순간 여성들로 하여금 남성을 살해하게 한다는 Walker의 순환이론은 그 연구 방법이 가지는 허점으로 인해 법적 증거로서 증후군이 가지는 과학적 가치를 의심받게 하며, 증후군의 오남용은 정당방위로 변호될 수 있는 가정폭력 피해여성의 법적 입지를 좁힐 수 있다.
피학대여성 증후군이 가정폭력으로 인해 남편을 살해한 여성들의 상황과 심리적 상태를 일반에 이해시킨 것은 학문적으로 가치 있는 일이나 피학대여성 증후군이외 다양한 유형의 가정폭력 피해 여성들을 변호할 수 있는 법리와 보다 과학적인 증거를 발굴하기 위한 노력이 필요하다.Domestic violence has destroyed a woman's mind as well as body and has dissolved family, and as a result could made her kids come to be a victim or a perpetrator of another crime. The cases of women who have murdered their husbands because of domestic violence are the most tragic consequence of such violence. Since 2000, in some korean courts decisions, BWS(battered woman syndrome) has appeared to defend a woman who murdered her husband. While the validity of BWS continue to be reviewed and doubted in American scholarly area and court's process where the arguments of BWS was produced, BWS has sometimes been used as evidence in a court proceeding, without sufficient review of its' reliability in Korea.
For this paper, we did depth interview with 16 incarcerated women who have killed their husbands. The analyses find that the women did not leave their husband not because of learned helplessness, but because of more realistic causes, such as her husband's revenge, fear on her own life after divorce and security of her kids. In fact, the women did not get timely help from a policeman, a family member or a neighbor, regardless of her asking for it. Also, Walker's circular theory in which accumulated violence can abruptly at a moment cause her murder has been subject to serious suspicions in its' validity because of its' methodological defects. The misuse of BWS can rather narrow the possibility that the battered women could be defended as self-defense.
Although, as a matter of scholarly sense, it is valuable that battered women syndrome has contribute to enhance the public's understanding about circumstances and psychologies of women who killed her husbands, more objective, reliable and scientific evidence should be developed and used to defend more various women who are both victims and perpetrators.
