동아시아 전통국가의 정치체제에 대한 연구에서 법에 관한 연구는 매우 희소한 편이다. 그 이유는 대략 두 가지이다. 첫째, 이 정치체제가 전제정적이고 통치자의 자의에 의해 지배되었으므로, 법체제가 미비했다는 관념이다. 둘째, ‘예치주의’가 강조되고 ‘법치주의’가 경시되었다는 관념이다. 그러나 동아시아의 전통 정치체제에서 ‘민심’과 ‘공론’은 정치적 정당화를 위한 핵심적 요소였고, 매우 포괄적이고 세련된 법률체계를 가지고 있었다. 다른 한편 예치주의는 법치주의를 배제하는 것이 아니라 상호 보완적이었고, ‘예치주의’의 이상을 적절히 실현하기 위해서는 오히려 적절한 법체계가 필수적으로 요구되었다. 조선 초기의 활발한 법전편찬은 이러한 의도의 산물이었다. 그러나 세종대의 사법상황을 검토해 볼 때, 조선 정치체제는 ‘예치주의’를 실현하는 데 근본적인 난점을 가지고 있었다. 그것은 첫째, 법의 미비와 관리들의 엄형주의로 인해 법의 보호가 매우 취약했다는 점이다. 둘째, 신분제의 원리와 예치주의의 부조화로 인해, 평민층에 대한 관리 및 양반층의 자의적 폭력을 억제할 수단이 근본적으로 결여되어 있었다는 점이다. 셋째, 백성의 주권이 부재했기 때문에 백성의 권리를 보호할 수단이 원천적으로 부재했다는 점이다. 이 때문에 사법생활을 개선하려는 세종의 노력은 현실적으로 큰 한계를 가지고 있었다.There are very few studies on East Asian traditional law. It would be caused by following misconceptions: The first, the law system was not properly constituted in the premodern East Asian societies because those political systems was tyrannical and was ruled only by ruler's will; The second, they thought much of not legalism, but ritualism. But, people's support and public opinion had been recognized as the essential elements in political legitimacy. On this account, the premodern East Asian states had quite refined legal systems. Also, ritualism did not refuse legalism. They were not only complementary each other, but also ritualism needed the proper legalism to realize its ideal. By this reason, Chosun dynasty tried hard to codify a good constitution from early period. But, reviewing the legal reality of King Sejong's era, there were the fundamental difficulties to realize ritualism in Chosun dynasty. The first, safeguard by law was very weak by reason of insufficiency of law and official's severe punishment orientation. The second, Chosun dynasty lacked the political and legal methods to restrain officials and aristocrats from doing the arbitrary violence to commoner, fundamentally. The third, there was not means to guard people's right because commoner had not any political sovereignty, originally. So, though King Sejong had tried to improve commoner's legal life heartly, there were the insolvable problems in reality.
