원래 기본권은 전통적으로 대국가적 방어권으로서의 성격을 가졌기 때문에 기본권은 국가에 대해 주장될 수 있는 것이었다. 그러나 현대에 이르러 거대한 사회적?경제적 권력을 가지는 개인이나 단체에 의한 기본권 침해 사례가 빈발했다. 이러한 현실적인 필요성 때문에 국가가 아닌 사인에 대해서도 기본권이 주장될 수 있다는 ‘기본권의 제3자적 효력이론’ 내지 ‘기본권의 대사인적 효력이론’이 등장하였다.
미국에서는 이 ‘기본권의 제3자적 효력이론’ 내지 ‘기본권의 대사인적 효력이론’이 ‘State Action Doctrine’(주행위이론)이라 명명되며 탄생하고 미국 연방대법원의 판례들을 통해 발전되어 갔다. 이는 주로 미국 연방 수정헌법 제14조의 적법절차조항과 평등조항에서 적법절차의 보장주체나 평등권 보장의무의 주체로 “State(州)”가 규정되었기 때문에 이러한 명칭이 붙여진 것이었다. 즉, 私人의 행위에 州가 어떤 식으로든 관련되었거나 앞으로 관련될 것이라는 흔적만 있으면 사인의 그 특정한 행위를 주정부의 행위로 간주해 적법절차조항 위배나 평등권 침해를 그 私人에 대해 주장할 수 있다는 것이다.
본 연구는 이러한 주행위이론의 미국 연방헌법상의 여러 헌법적 근거조항들에 대해 살펴보고, 이 주행위이론과 관련된 미국 연방대법원의 주요판결들을 분석해 본 후, 미국에서의 주행위이론의 탄생과 발전과정을 추적해보는 것을 연구의 목적으로 삼는다. 특히 연방대법원의 주행위이론 관련 주요판결들로는 1948년의 Shelley v. Kraemer판결, 1966년의 Evans v. Newton판결, 1972년의 Moose Lodge No. 107 v. Irvis판결, 1974년의 Jackson v. Metropolitan Edison Co.판결, 1982년의 Rendell-Baker v. Kohn판결, 1991년의 Edmonson v. Leesville Concrete Co., Inc.판결, 2001년의 Brentwood Academy v. Tennessee Secondary School Athletic Association판결이 분석의 대상이 되었다.Traditionally, the constitutional rights have been claimed against the government in that it could be intruded not by the individual but by the government. However, in the modern times, the constitutional rights have frequently intruded by individuals who have enormous social and economic powers. Due to this necessity in the real world, 'State Action Doctrine' was born and has been developed in the United States by the decisions of U.S. Supreme Court. According to the Article 14 of the U.S. Constitution, the State should obey the due process in depriving the life, liberty and property of the people and should provide equal protection of laws. Hence, some private actions could constitute state action to which the Article 14 of the U.S. Constitution could apply.
This paper will examine constitutional grounds of 'State Action Doctrine,' analyze the concerned cases by the U.S. Supreme Court. Through that, this paper aims at exploring the birth and the development of 'State Action Doctrine.' As U.S. Supreme Court cases, Shelley v. Kraemer in 1948, Evans v. Newton in 1966, Moose Lodge No. 107 v. Irvis in 1972, Jackson v. Metropolitan Edison Co. in 1974, Rendell-Baker v. Kohn in 1982, Edmonson v. Leesville Concrete Co., Inc. in 1991, Brentwood Academy v. Tennessee Secondary School Athletic Association in 2001 will be analyzed.
