According to the Article 10 of Automobile Insurance Standard Clauses, the insurance company compensates for the accident which caused death or injury occurred while the insured using their insured car by assuring legal compensation for damages. And the one who drives a car for himself also should be responsible for the accident which caused death or injury of other persons occurred from that driving under the Article 3 of the Automobile Accident Compensation Security Act. Therefore the injured from the automobile accident must be included to the extent of the "other persons" in order to get reparation for injury.
Until the decision of the court in this study came out, the representative director of the corporation was not included in the extent of the other persons. So he could not get any compensation from the automobile accident. Because he was acknowledged as the person who drives for himself. However, the effects of the decision of the court the representative director of the corporation can be protected as the other person under the Automobile Accident Compensation Security Act. This study basically analyses the court decision and examines the extent of the other person under the Automobile Accident Compensation Security Act.
