현행 형사소송법은 압수대상물에 대한 규정을 두고 있지 아니하여, 어떤 물건에 대해서 압수가 허용?불허되는지가 불분명하고, 그에 대한 논의도 거의 진행되고 있지 않다. 대물적 강제처분인 좁은 의미의 압수는 피수사자의 소유권?점유권을 침해하는 수사방법이므로, 그와 같은 권리침해가 없는 경우라면 영장 없이도 수사기관이 확보할 수 있다고 해야 한다. 유실물, 무주물 뿐만 아니라 지문, 혈흔 등의 정보의 자료 또한 이와 같은 권리의 대상이 아니므로 수사기관이 독자적으로 취할 수 있다고 보는 것이 타당하다. 한편, 압수금지 내용이 소수 규정되어 있지만 그것은 국가기관의 기밀을 보호하기 위한 것이거나 특정 직업활동을 보호하고자 하는 것이며, 개인의 권리를 보호하기 위한 압수제한에 대한 논의도 부족한 상황이다. 우선 nemo tenetur-원칙과 그것이 구체화된 진술거부권이 처분될 수 없는 피의자?피고인의 가장 중요한 권리임을 생각해 본다면 물건의 압수를 통하여 이와 같은 권리를 침해하는 방식은 허용되어서는 안 된다. 나아가 피의자?피고인의 방어권행사를 위하여 반드시 필요한 물건에 대한 압수도 금지되어야만 하며, 개인의 사생활보호나 언론?출판의 기본권 등을 보호하기 위하여 강제처분이 금지되어야 하는 경우도 분명히 확인되어야 한다.Answers to the questions concerning seizure (how it needs to be done, which items are seizable, etc.) need to be deduced from considering the reason why the seizure institution is prescribed in Korean Criminal Procedure Act. ‘Seizure’, which is a Compulsory Disposition on objects, needs to be conducted on the basis of a warrant issued by a judge, since it is one of Compulsory Disposition methods. It requires the subject person of investigation to be specified since his/her rights are exposed to infringement. However, when the recipient of the warrant is not designated or one does not have ownership/possessory right to the objects, then such objects can be secured without any ‘Seizure’ process. The objects which require ‘Seizure’ process and the information which can be obtained from them need certain distinguishment. Materials such as fingerprints, bloodstains can be secured without the ‘Seizure’ procedure and does not require any warrant.
Current Korean Criminal Procedure Act has several restrictions which are additional to the Principle of Warrant in terms of habeas corpus. However, in case of Compulsory Disposition on objects, especially seizure, there are no such restrictions except for the Principle of Warrant which is applied in some cases. But even then, it is not for the protection of individual’s rights, but for the protection of State Agent’s or certain occupations’ secrecy in practice. Since the nemo tenetur principle and the Right to Silence are inviolable rights for a suspect/defendant, infringement of such rights during a seizure process should be prohibited. Documents or electronic device with statements should not be considered as seizable objects. Moreover, objects which are necessary for right to defend should not be considered seizable. Also, seizure methods need to be disambiguated for the protection of individual privacy and for the freedom of speech and press.
