우리 정부는 기후변화와 에너지 위기를 극복하기 위해 녹색성장정책을 표방하고, 이를 총괄하는 기구로서 녹색성장위원회를 설립하였다. 그러나 녹색성장정책 전담기구의 필요성이나 국제협력의 측면에서 녹색성장위원회 설립의 정당성은 인정받을 수 있다. 그러나 녹색성장위원회의 설립과정을 살펴보면 절차법적 측면에서 문제가 있는 정부위원회이다. 또한 현행 녹색성장위원회의 법적 성격은 정부위원회 중 대통령 소속의 자문위원회로 볼 수 있는데, 법적 안정성 측면에서도 문제가 있다. 그동안 녹색성장위원회 뿐만 아니라 정부위원회들이 임의적으로 설립된 것은 정부조직법에서 위원회 설립 및 절차와 관련한 일반적 기준이 없었기 때문이다. 따라서 헌법에 부합하는 정부조직을 구성하기 위해서는 정부위원회의 설치요건 및 절차에 대한 일반적 기준이 정부조직법에 규정되어야 한다. 정부위원회를 정부조직법에서 성격과 기능에 따라 각각 기준을 정한다면 녹색성장위원회는 행정위원회로 법적 지위를 부여하는 것이 타당하다. 녹색성장위원회를 행정위원회로의 법적 지위를 부여하는 경우 녹색성장 정책을 효율적으로 추진하고, 위원회의 안정성을 가져올 수 있다. 또한 현행법에서는 녹색성장위원회의 업무범위가 지나치게 포괄적으로 규정되어 있는데 업무영역 범위를 보다 구체화하여 담당하게 할 필요가 있다.Korea government announced the green growth policy in order to solve climate change and energy crisis. It created the Committee on Green Growth to administrate tasks related with the green growth policy. It is justifiable to establish the Committee in relation to the necessity of having an organization in charge of the green growth policy and international cooperation. The procedural aspect in relation to establishing the Committee is, however, controversial. The legal status of the Committee can be considered as an advisory committee under the President. It creates a potential problem in terms of legal stability. The arbitrary establishment of other governmental committees as well as the Committee on Green Growth has been possible due to the absences of general standards related with the establishment and operation of committees in National Government Organization Act.
Therefore, this article argues that the National Government Organization Act should contain general standards about the procedure and requirement for establishing government committees in order to form constitutionally agreeable government organizations. It also suggests that reclassification of the National Government Organization Act according to its character and function justifies the legal status of the Committee on Green Growth as an administrative commission. This article further claims that new status of the Committee would efficiently advance the green growth policy and the stability of the Committee. It finally concludes that overly generalized responsibilities of the Committee need to be specified in order to avoid unnecessary conflicts with other government organizations.
