2009년 개정된 방송법은 방송사업자에
대한 독과점 규제 제도를 진입규제와 기업
합병등에 대한 구조규제 중심에서 행태의
결과를 발생시키는 원인에 따라 진입 및 소
유를 제한하는 형태로 바뀌었다. 일반적으
로 경쟁법은 시장지배적 사업자에 대한 구
조규제와 불공정거래행위에 대한 규제에
집중한다. 그러나 방송법은 시장지배적 사
업자가 등장하는 것을 원칙적으로 금지하
고 있으며, 불공정거래행위에 대한 규제는
언론의 자유를 금지하거나 사전 검열이 될수 있어서 사후적인 내용심의 등에 집중한
다. 또한 경쟁법과 달리 여론지배적 사업자
에 대한 규제를 하는데, 이때 적용되는 기
준은 사후적인 행태의 결과인 시청점유율
을 가지고 사전규제의 영역인 기업의 소유
와 지분을 규제한다.
개정방송법 제69조의2는 방송사업자의
시청점유율이 30%를 초과하는 순간부터
방송사업 소유제한, 방송광고시간 제한, 방
송시간의 일부 양도 등을 통해 규제하도록
정하고 있다. 그러나 이 과정에서 기술혁신
과 모범적인 경영, 양질의 프로그램 개발을
통해 자연적으로 성장한 시청점유율을 근
거로 방송사업자에게 불이익을 결정하면서
직권규제를 중심으로 할지 당사자주의를
채택할지에 대한 명확한 규정도 없으며, 특히 자연성장과 인수합병을 통한 시장성장
을 동일한 기준으로 규제하는 불합리한 측
면이 있다.The Korean Broadcasting Act amended in the year of 2009 which focused it’s
monopolistic and oligopolistic regulations for a broadcasting organization on entry and
structural control is changed to the form of entry and ownership restrictions according
to the reasons of results. While the Prevention of Unfair Competition Act normally
concentrates on the structural control for the dominant organization in the market and
on the regulation for unfair trading practices, the Broadcasting Act prohibits as a rule
the appearance of the organization which has dominant position in the market. In terms
of regulation for unfair trading act, the Broadcasting Act focuses on contents deliberation
as an ex-post censorship, as the regulation could prohibit the freedom of speech or could
be a pre-censorship. The Broadcasting Act, different from the Prevention of Unfair
Competition Act, controls a broadcasting organization which has dominant public
opinion, hereat the ownership and shares, the sphere of pre-censorship, is controled in
accordance with the share of audience, the form of post-censorship.
The second clause of Article 69 of the Korean Broadcasting Act provides regulation
of ownership and restriction of advertising time, if the share of audience of a broadcasting
organization exceeds 30%. Deciding even disadvantage of broadcasting organizations
based on the share of audience which has grown up as a natural result through innovation
of technology, exemplary management and development of good program, there is no
rule for the propper adoption whether the compulsory regulation or the adversary system is more suitable. Especially, it’s illogical to control the both of natural growth and market
growth through merger under the same criteria.
