오늘날 많은 국가들이 환경 부정의 상태를 개선하고 구성원 각자가 환경이익에 대한 공정한 몫을 받고 손해에 있어서도 공평하게 분배될 수 있는 환경책임법을 제정하고 환경책임법제 체계를 정립하려고 노력하고 있다. 우리나라도 환경책임법의 필요성을 인식하고 이를 제정하고자 하는 움직임이 있어왔다. 환경책임법을 제정함에 있어서 환경피해 또는 손해를 환경피해자, 오염원인자 그리고 사회가 어떻게 그 책임을 합리적으로 분담할 것인지에 대해 중요한 문제가 되고, 이는 환경정의의 관점에서 살펴보아야 한다. 구체적으로는 환경정의의 개념요소인 교정적 정의, 분배적 정의, 사회적 정의, 절차적 정의의 관점에서 환경책임법이 구현될 수 있도록 입법하여야 한다. 따라서 환경정의에 부합하는 환경책임법을 제정하기 위해서는 먼저 환경손해에 대한 개념을 명확하게 정립하고, 회복 또는 배상되어야 할 환경손해의 범위를 결정하여야 한다. 환경손해에 대한 책임법리를 구성함에 있어서는 피해자를 사회적 약자로 보고 위험을 재분배할 수 있는 위험책임법리를 도입하여야 한다. 그리고 환경손해에 구제제도로서 사법상의 사후적인 환경손해에 대한 구제 제도뿐만 아니라 사전적 예방기능을 할 수 있는 공법상의 구제제도도 같이 포함되어 있어야 한다. 또한 오염원인자 책임에는 일정한 한계가 있기 때문에 기금제도 또는 환경보험제도를 통해 오염원인자에 의해 담보되지 않는 환경손해를 구제받을 수 있도록 규정하는 것이 타당하다. 마지막으로 절차적 정의의 측면에서 환경정의를 실현하는 정보제공청구권 또는 정보열람청구권도 환경책임법에서 규정되어야 한다.Today many countries are trying to establish ‘environmental liability act’ that can rectify environmental injustice and distribute environmental benefit fairly to each member while apportioning the loss evenly. Korea recognizes the necessity of ‘environmental liability act’ and is trying to legalize such act. An important issue in enacting ‘environmental liability act’ lies with the distribution of environmental damages and losses among its victims, polluters and society according to the responsibility of the respective parties. More specifically, it should be enacted in the light of four concepts of environmental justice: corrective justice, distributive justice, social justice and procedural justice. Thus to establish such ‘environmental liability act’ which corresponds to environmental justice, the concept of environmental damage should be clearly defined and the range of which is to be recovered or compensated should be decided. In constructing a legislative system related to environmental responsibility, the Act should adopt strict liability which considers victims as a vulnerable social group and is apt to redistribute risks. The Act should not only comprise a civil relief system as an ex-post measure but also a public relief system as a preventive control system in the relief of environmental damages.
Since polluter’s liability has its limit, the Act should be supplemented by a funding or a environmental insurance system to pay for damages that cannot be compensated by the polluters. Finally, it should enact provisions for the claims to information or claims of information disclosure that can realize environmental justice in terms of procedural justice.
