휴대전화 전자파의 인체 유해성에 대한 국내외 관심이 고조됨에 따라, 우리 정부는 2012년 9월 전자파에 관한 정보를 국민들이 더 쉽게 인지할 수 있도록 하기 위한 목적에서 전자파등급제의 시행을 예고하였다. 당초 전자파등급제는 휴대전화 단말기의 전자파흡수율 측정값에 따라 1등급과 2등급으로 구분된 전자파흡수율 등급라벨을 휴대전화 단말기의 포장상자에 표시하도록 의무화하는 상표부착요건으로서, TBT협정과의 양립성이 요구되는 기술기준이다. 동 사안에 대해 교역상대국인 미국과 EU는 특히 전자파흡수율 등급분할을 뒷받침할 수 있는 과학적 증거 부재를 이유로 들어 TBT협정 위반 가능성을 제기하였다. 결국 전자파등급제는 이들 국가들과의 양자협의를 통해 주요 쟁점을 해소한 이후인 2013년 8월 제정될 수 있었다. 본고는 ICT분야 최초의 상표부착요건에 관한 통상마찰 사례인 전자파등급제의 추진과정을 통해 표출된 통상쟁점을 분석함으로써 상표부착요건의 TBT협정 양립성 차원에서 각별히 유념해야 할 통상법적?정책적 시사점을 모색한다.Amid rising concerns home and abroad on the risk to human health brought about by exposure to mobile phone EMF(Electro-Magnetic Frequencies), Korean government released a notice of the SAR grading system on September 2012. It aims to help people better understand EMF information in using mobile phones. The SAR grading system is a labelling requirement that mandates the indication of SAR grading labels on packing cases of mobile handsets, either grade 1 or 2 based on their SAR value measurements. As a technical regulation, the system is required to comply with the TBT Agreement. The USA and EU of Korea’s trading partners instituted concerns on possible violation of the TBT Agreement in connection to the system, particularly because there is no scientific rationale for why a distinction of SAR values should be made. The SAR grading system was finally enacted on August 2013, after solving pending trade issues through bilateral consultations with those countries. This study seeks to figure out legal and policy implications we should take note of to make labelling requirements go along with the TBT Agreement. For that purpose, it analyzes trade law issues exposed in the process of promoting the SAR grading system which is the first trade friction case on labelling requirements in ICT industry.
