행정쟁송은 프랑스에서 시작되어 독일과 일본을 거쳐 우리나라에 계수되었다. 계수될 당시의 소원제도는 대륙법계 전통에 따라 개인의 권리구제기능과 법원의 부담경감기능도 수행하였지만 자율적 통제장치로서의 역할이 우선하였던 것은 분명하다. 그러다보니 권리구제에 소홀하여 행정소송의 제기만 어렵게 한다는 비판이 일게 되었고, 제5공화국 헌법에서는 행정심판의 헌법적 근거를 마련함과 아울러 미국법에서 유래하는 행정심판위원회를 도입하고 사법절차를 준용하도록 하였다. 그리하여 행정심판법이 종전의 소원법보다 권리구제기능을 대폭 강화한 형태로 제정되었고, 우리나라만의 독특한 제도로 자리를 잡았다. 이에 더하여 1998년의 행정소송법의 개정으로 원고가 행정심판을 거칠지 여부를 선택할 수 있게 됨으로써 그 해석상의 혼란이 가중되었다.
행정의 불복절차, 행정기관에 의한 구제절차, 쟁송절차라는 요소를 포괄할 수 있는 개념은 (넓은 의미의) 행정심판일 수 밖에 없다. 그러나 이 행정심판의 개념은 다른 법률용어도 그러하지만 적용되는 국면에 따라 그 광협이 달라질 수 있는 것이다. 어떠한 행정상 불복절차가 행정심판법상 행정심판을 대체하는 것인지 아닌지가 주된 관심사인 행정심판법에서의 행정심판은 심판기관의 독립성이나 심판절차의 공정성등의 요소를 갖출 것을 요구한다. 그러나 어떠한 행정상 불복절차가 행정소송의 전심이 될 수 있느냐는 관점에서 해석해야 하는 헌법상의 행정심판의 개념과 행정소송을 제기할 요건을 갖추었느냐의 관점에서 해석해야 하는 행정소송법상의 행정심판의 개념은 행정심판법상의 행정심판과는 다른 것임이 분명하다. 그런데 제소기간의 기산점을 언제로 하여하는지의 문제는 행정소송과 행정심판의 관계에 관한 것으로서 넓은 의미로 파악해야 함에도 불구하고 대법원의 일부 판결은 이러한 점을 인식하지 못하고 단순하게 해석한 나머지 국민의 재판청구권을 침해하는 방향으로 해석하는 오류를 범하고 있다. 이는 시급히 고쳐져야 한다고 생각한다.The system of Korean administrative appeals traces its roots from French law by way of German and Japanese law. At the point of introduction, it encompassed relief of individual rights and functioned to lessen the burden of courts. But more than anything, it played the role of autonomous regulation. Consequently, criticism arose on how it lacked in protecting individual rights and the difficulty in bringing an administrative litigation. As an answer to such criticism, the Constitution of the 5th Republic government introduced administrative committees modeled on those of the US legal system, and mandated that administrative trials adopt judicial procedures. Accordingly, the Korean system of administrative trials was established in a unique way that greatly enhanced relief of individual rights. Yet, the 1998 amendment of Administrative Litigation Act made it possible for the plaintiff to choose whether to bring a case through an administrative trial or not, leading to further confusion in interpreting its provisions.
The term “Administrative Trial” covers appeals of administrative decisions, relief through administrative agencies, and general administrative appeals. But the range of its concept may vary depending on what it is applied to, similar to other legal terms. The system of administrative trials is mainly concerned with whether an appeal of an administrative action may substitute an administrative trial, and thus mandates that the legal authority be independent and the legal procedures be fair. From a Constitutional law perspective, the question regarding administrative appeals is focused on whether it should be followed by administrative litigation. From an administrative law perspective, the question is focused on whether an administrative appeal satisfies all the elements to bring an administrative litigation.
But the question of when a Statute of Limitation for a legal action runs needs to be determined in broad terms considering the relationship between administrative litigation and administrative trials. Yet, some rulings by the Supreme Court do not perceive this point and have interpreted the term in a narrow way that may invade an individual’s right of access to courts. This needs to be amended as soon as possible.
