채권자대위권에 관한 민법 제404조는 채권자는 자기의 채권을 보전하기 위하여 채무자의 권리를 행사할 수 있다고 하므로 채권의 보전에 적합한 것이면 모든 권리가 대위권의 객체가 되는 것이 원칙이다. 민법 제404조에서는 일신전속권은 예외적으로 채권자대위권의 객체가 되지 않는다고 규정하고 있다. 이것과는 별개로 민법 제1005조에서도 상속에 관하여 일신전속권을 규정하고 있다. 일반적으로 양자는 서로 개념이 다른 것으로 보아, 민법 제404조가 규정한 일신전속을 ‘행사상의 일신전속권’, 민법 제1005조가 규정한 것을 ‘귀속상의 일신전속권’이라고 한다.
일신전속권은 일신에 관한 권리와 전속하는 권리의 양자가 결합된 것이고, 후자인 전속하는 권리에는 재산적인 것도 있고 비재산적인 것도 있을 수 있지만, 전자인 일신에 관한 권리는 사람 자체에 관한 권리를 말하므로, 권리 주체인 사람을 떠나서는 존재할 수 없는 인적․비재산적 권리만이 일신전속권이 될 수 있다. 일신전속권을 이와 같이 본다면, 민법 제404조에서 규정한 것이나 제1005조에서 규정한 것 모두 동일한 것이므로 일신전속권을 행사상의 것과 귀속상의 것으로 구분할 필요가 없다.
일신전속권은 인적․비재산적 권리이므로 기존의 채권자대위권행사의 대상인지 여부가 문제된 권리 가운데 인적․재산적 권리는 일신전속권이 아니다. 그러나 일신전속권이 아니라고 하여 모두 채권자대위권행사의 대상이 되는 것이 아니다. 민법 제404조에서 규정한 일신전속권뿐만 아니라 그 밖의 권리도 채권자대위권제도의 목적이나 성질. 당사자의 의사표시, 당해 권리의 성질 등에 의하여 그 행사가 제한될 수 있다.
비재산권으로서의 인격권 및 신분권 등은 민법 제404조가 규정한 일신전속권이므로 대위권행사의 대상이 되지 아니한다.
채권자대위권은 책임재산 또는 공동담보를 보전하기 위한 제도이다. 그러므로 책임재산이나 공동담보가 될 수 없는 것은 채권자대위권행사의 객체가 될 수 없다. 가령 압류할 수 없는 권리, 부양청구권 등은 채권자들의 공동담보가 되지 아니하므로 이러한 권리들은 채권자대위권행사 대상에서 제외되는 것이다. 보전행위가 아닌 채무면제․권리포기․기한허여 등은 채권자가 대위할 수 없고, 집행절차로서 기능을 하여 채권자가 궁극적으로 자기 채권을 만족시키는 채권양도통지도 허용되지 않는다. 또 채권자대위권은 채무자가 권리행사를 할 수 있음에도 이를 게을리 한 경우에 행사할 수 있는 권리이므로, 채무자가 이미 소송의 방법으로 권리행사를 하고 있는 경우에 있어서 채권자는 채무자의 개개의 소송행위에 관여할 수 없다.
채무자의 제3채무자에 대한 권리의 성질상 채권자의 대위가 불가능한 경우가 있다. 가령 재산권으로서의 인격권(퍼블리시티권), 신분 자체의 침해로 인한 위자료청구권, 이혼에 따른 부부간의 재산분할청구권, 상속의 승인․포기, 상속재산분할청구권, 유류분반환청구권, 계약의 청약과 승낙 등은 그 권리 자체가 불확정적인 것이어서 대위권의 객체로 되지 못한다.
마지막으로 상속지분권이나, 임대차의 경우에서 보는 바와 같이, 하나의 권리 자체를 일률적으로 대위권의 대상이 되는지 아닌지를 판단할 수 없으므로 구체적인 내용을 개별적으로 살펴 대위권의 대상여부를 가려야 한다.The Article 404 of Korean Civil Code prescribes that the Obligee may, in order to conserve his claim, exercise the rights belonging to the Obligor. Therefore, it is an accepted principle that all rights suitable for conserving the Obligee's claim can be an object of the obligee’s right of subrogation.
Also, the Article 404 prescribes that the rights exclusively attached to the person cannot be exceptively an object of the obligee’s right. There are same rights exclusively attached to the person in the Article 1005. Most scholars think that the rights in the Article 404 have a different meaning from the rights in the Article 1005, and that the latter are rights exclusively attached to the person in attribution, the former are rights exclusively attached to the person in exercise.
I think there is no difference between two types of rights exclusively attached to the person, because the two types of the rights exclusively attached to the person have characteristics as a personal rights and one of rights of non-property related with individuality of a person.
If the rights of which the character of the rights belonging to the Obligor has been discussed have a character as a right of property, we do not regard the rights as the rights exclusively attached to the person. Nevertheless, all rights having a character of property cannot be an object of the obligee’s right of subrogation. The object can be limited on the reason of the aim of the obligee’s right of subrogation, the manifestation of will, and personal character of the rights belonging to the Obligor.
Personality rights and rights to identity having a character as a personal rights and one of rights of non-property cannot be an object of the obligee’s right of subrogation.
The obligee’s right of subrogation is an institution for conserving the general security. The obligee can not exercise rights which cannot be seized or be rights to claim for support, which cannot be a general security. It is same to waiver of an obligation, waiver of rights, and extension of the deadline for payment, which does not mean an conserving act. The obligee can not notify the transfer of claim by force of the Article 404, because an act like that is not conservative but executive.
The Obligee may exercise the rights of the Obligor neglecting the exercise of his/her rights, So he/she can not step into the obligor's individual judicial acts.
Sometimes the obligee cannot exercise the rights of the obligor because of the personal character of the rights, such as rights of publicity, claim to consolation money in case of the injured life or body, claim for division of property in case of divorce, acceptance or renunciation of succession, partition of inheritance estate, claim to return of legal portion of an heir, offer or acceptance of contract, and many other rights undetermined.
Finally, if a right is composed of several elements such as claim to the share of inheritance or claim on the basis of a lease, the possibility of exercise about the obligee's right of subrogation should be settled individually by the character of the element.
