해양거버넌스는 주로 해양환경보호와 해양생물다양성 유지를 위해 지구적·지역적 국제기구와 한 국가의 중앙정부와 지방정부 등이 마련되는 연성규범을 포함하는 각종 규범과 공식적·비공식적 제도를 포함하는 매우 포괄적인 기제이다. 해양거버넌스에 속하는 것으로 사료되는 원칙에 대해서는 다양한 의견이 있지만, 본고에서는 인류공동유산 원칙, 지속가능개발 원칙, 해양환경보호의무, 생태계접근방법, 예방의 원칙을 살펴보았다. 오늘날에는 해양에 대한 통합관리와 생태계기반 방법의 적용을 목적으로 하는 구역기반접근방법이 주목을 받고 있는바, 이와 관련하여 그 구체적 방법인 해양공간계획(MSP)과 해양보호구(MPA) 제도의 내용과 장단점을 살펴보았다. 그 명칭이 어떠하든 구역기반접근방법은 해양환경보호에 기여하는 것으로 평가되지만, 보다 효율적인 관리를 위해서는 관련 과학지식의 축적과 사회경제적 측면에 대한 고려가 요구되고 있다.
전지구적 해양거버넌스는 1982년 해양법협약에 상당부분 반영된 것으로 보며, 생물다양성협약과 공해어업협정과 같은 관련 국제협약에 의하여 보완되었다. 하지만, 해양거버넌스는 FAO의 국제행동계획(IPOA)을 포함하는 연성법적 규범들에 의해서도 보완된다. 본고에서는 전지구적·지역적 해양거버넌스 중에서 해양환경보호와 해양자원관리에 관한 부분을 특별히 심도가 있게 분석하였다.
동북아시아는 해양이 지리적으로 복잡하고 해결되지 아니한 과거사 문제와 동서간 냉전의 그림자가 남아있어서, 한 동안 해양문제의 해결을 위한 국가간 대화가 활발하지는 못했었다. 그러나 동아시아의 해양은 모두 반폐쇄해이어서 해양오염에 취약한 구조이고 북한을 제외한 동아시아 국가들은 모두 고도로 산업화된 국가이어서 대책마련이 시급한 실정이다. 본고에서는 동아시아 지역에서의 해양관리제도의 효율성과 문제점을 검토하기 위하여, 북서태평양보전실천계획(NOWPAP)과 황해광역생태계보전사업(YSLME) 등 다자적·양자적 협력제도들을 분석하였다. 아울러 한국, 중국, 일본의 정부조직과 관련 법제도를 분석하여 그 차이점을 알아보고 발전방향을 제시하였다.Ocean governance is a popular mechanism comprising hard and soft law rules and formal and informal institutions which are provided by global and regional organs and central and local governments. This article enumerated ocean governance principles such as Common Heritage of Mankind principle, sustainable development principle, obligation to protect marine environment, ecosystem approach principle, and precautionary approach principle. Nowadays, Place-Based Approach is a popular model as an integrated and ecosystem-based approach for ocean governance. Marine spatial planning(MSP) and marine protected area(MPA) which are methods for Place-Based Approach are examined to evaluate advantages and limits of the methods. Place-Based Approaches have contributed to better marine environment, but increase in knowledge on science and nature and due regard to the socioeconomic factors are necessary.
Global ocean governance was provided by the 1982 Law of the Sea Convention and other relevant international conventions such as Convention on Biological Diversity(CBD) and Fish Stock Agreement. However, ocean governance is supplemented by soft-law instruments including international plans of action adopted at FAO. Especially, ocean governance systems on marine environment preservation and marine resources management are analyzed carefully.
All the seas in Northeast Asia are semi-enclosed seas weak to marine pollution, and all the coastal states except North Korea are highly developed industrial countries. In order to examine the efficiency of marine management system in this area, this article investigated the multilateral and bilateral cooperation systems like the NOWPAP, YSLME and Korea-China Yellow Sea Joint Inspection Project. Government systems and legal systems of Korea, China, and Japan are also analyzed to confirm differences and to find improvements necessary. Given that regional cooperation system in Northeast Asia still remains inefficient and fragmented, ocean governance in this area should be modified to be more integrated and more ecosystem friendly.
