2014년 12월 19일 헌법재판소는 통합진보당에 대한 해산결정을 내렸으며, 소속 국회의원들의 의원직상실을 선고하였다. 대한민국 헌법사상 최초의 정당해산심판은 매우 큰 파장을 불러일으켰으며, 찬반 논쟁은 아직도 진행 중이다.
이 논문은 헌법재판소의 결정에 대한 간략한 정리와 더불어 핵심적 쟁점 12개를 분석⋅정리한 것이다. 정당해산심판제도의 도입취지에 대한 오해, 정부의 제소가 적법한 것인지에 대한 논란, 정당해산이 아닌 선거를 통해 해결했어야 한다는 주장의 문제점, 은폐된 목적에 대한 검토의 필요성, 진보적 민주주의의 해석을 둘러싼 쟁점들, 이석기 내란관련사건의 의미와 비중, 비례대표 부정경선과 당내 폭력, 여론조작 등의 의미, 통합진보당의 통일정책이 갖는 특별한 의미, 목적과 활동의 종합적 판단 및 여기서 문제되는 ‘퍼즐 맞추기’를 둘러싼 논란, 정당해산요건으로서의 구체적 위험의 판단기준, 의원직상실의 근거, 그리고 결정의 시기에 대해 정리하였다.
이러한 분석의 의미는 헌법재판소의 결정을 정치적 선입견 없이 법적 관점에서 이해하고자 하는데 있다. 헌법재판소의 결정은 통합진보당의 목적과 활동에 대한 ‘법적’ 평가에 기초한 ‘통합진보당’ 해산결정이지 야권에 대한, 혹은 진보세력에 대한 비판이나 평가를 담고 있는 것이 아니다. 따라서 이 결정의 의미를 ‘정치적’인 것으로 왜곡하거나 ‘통합진보당 이외의 야권 내지 진보세력’으로까지 확대해석하는 것은 옳지 않기 때문이다.
통합진보당의 해산결정은 보수와 진보의 문제가 아니라 위헌적 활동에 대한 법적 평가일 뿐이며, 그 이상도 그 이하도 아니다. 보수의 승리라고 볼 것도 아니고, 진보의 패배로 받아들일 것도 아닌, 단지 위헌정당의 해산일 뿐이다. 굳이 승자를 따지자면 민주주의이고, 패자를 지칭하자면 통합진보당의 그늘에서 위헌적 목적과 활동을 주도하던 자들이다. 그런데 여기서 보수와 진보의 갈등으로 대한민국의 헌법질서가 흔들리게 된다면 그것이야말로 보수와 진보가 모두 패자가 되고, 오히려 오늘의 패자인 그들을 승자로 만들어주는 것밖에 되지 않는다.
오늘날 보수세력과 진보진영이 헌법재판소 결정에서 반드시 취해야 할 점의 한 가지는 극단적 대립과 선명한 투쟁만을 강조하는 강경보수, 강경진보는 결코 바람직하지 않다는 것이다. 극단적 행동과 선명한 주장이 눈에 잘 띄는 것은 분명하지만, 그것은 결코 다수 국민의 지지를 받지는 못한다. 폭력과 불법을 수반할 경우에는 더욱 그러하다.
눈에 확 띄는 것은 극단주의자들일지 몰라도 민주국가에서 최종적 결정권을 갖는 것은 조용한 다수 국민들이다. 이번 헌법재판소 결정은 극단주의를 배제하는 헌법적 요청을 확인한 것이며, 그에 대한 다수 국민들의 지지는 보수세력에 대한 지지가 아니라 중도적이고 합리적인 정치세력에 대한 열망의 표현이기도 한 것이다. 그런 의미에서 이번 헌법재판소 결정이 가장 잘 실현되는 것은 극단적 보수나 진보가 아닌 중도적이고 합리적인 보수와 진보가 힘을 얻는 것이라 할 수 있을 것이다.On December 19th 2014, the Constitutional Court of Korea ordered the dissolution of ‘Unified Progressive Party’(UPP), the respondent party, and forfeited seats from National Assembly occupied by the party. This historically exceptional verdict of party dissolution in Korean Constitution arouses an enormous dispute and its controversy is still an ongoing issue.
This paper summarizes the Constitutional Court’s adjudication and analyzes 12 essential issues as following: the misinterpretation on enacting the judicial system on dissolution of a political party, controversies surrounding the legitimacy of the government’s legal action against UPP, drawbacks of alternatively proposed solution to utilize election over judicial dissolution, the sine qua non of examining concealed objectives of the respondent, issues of interpreting progressive democracy, representative Lee Seok-ki’s trial for treason and its meaning and impact, problems caused by proportional representation such as illegitimate candidacy in primary election, violence within central committee and manipulation of public poll, the meaning and purpose pertaining to UPP’s activities in regards to its “Unification Policy” and controversy around invisible hand being in responsible for this puzzle play, criteria on which specific danger of the respondent affected standard of ruling the dissolution, legal basis on which the forfeiture of UPP’s seats was based upon, and finally the temporal aspect of the adjudication.
The analysis intends to understand the Court’s ruling in strictly legal terms without any political stereotype. The Court’s decision to disband UPP was to uphold their legal objectives and activities based on legal evaluation; however the decision does not imply criticism nor evaluation of the Opposition Party (New Political Vision Party) and the Progressives, as a whole. The reason being, it is unwarranted to distort the meaning of the decision to have any political implication or to target the Progressives apart from UPP.
The Court’s order to disband UPP is not a ruling against the party’s extremity of its political spectrum; but rather, it is nothing more than a judicial decision based on the party’s unconstitutional activities. The result of the judgment implicates neither the defeat of the Progressives nor a victory of the Conservatives. The Court’s decision’s only implication was to disband a party which its activities were constitutional unjustified. The true winner of this decision was democracy and the losers are those who led the unconstitutional and unlawful activities behind the scene. However, if the very foundation of Constitutional Law was to be swayed by the Conservatives and the Progressives, it will be a loss as a whole with eventual victor left with a meaningless victory.
Today, the one thing that both the Conservatives and Progressives have to take away from this decision is that extreme political polarization of the radicals of both sides yields undesirable results to both. It is clear that radical actions and definite, stonewall claims help to grasp more attention; yet, mere spotlights do not necessary translate into the public support. This principle becomes more evident when violence and illegal actions are accompanied.
Even though the radicals are tend to grasp society’s attention with its extreme actions and political view; however, the ultimate decisions in democracy are made by the voting public. The Court’s ruling confirmed the constitutional request to eliminate political extremist and furthermore, the public’s support was not due to their conservative nature but rather expressed public’s yearning for moderate and rational political force. Hence, the best way to realize the Court’s judgment and its implications is to empower moderate and rational conservatives and progressives over the radicals.
