헌법재판소장으로서 2006년 9월부터 2012년 8월까지 6년간 활동한 제4기 헌법재판소를 이끈 이가 바로 이강국 헌법재판소장이다. 그가 이끈 제4기 헌법재판소는 제1기부터 제3기 헌법재판소가 18년간 쌓아올린 헌법재판의 초석과 기틀을 발전시켜 나가면서 우리 사회에 큰 파장을 불러일으키는 중요한 헌법적 결정들을 많이 내렸다.
본 연구는 이러한 이강국 헌법재판소장의 판결성향을 분야별 주요사건을 중심으로 정성적으로도 평가한 후, 전체 사건의 통계를 통해 정량적으로도 분석해 봄으로써 그의 판결성향을 귀납적으로 규명해 보는 것을 연구의 목적으로 삼는다. 이를 위해 우선 이강국 헌법재판소장의 주요 경력을 상세하게 살펴본다. 또한 이강국 헌법재판소장이 제4기 헌법재판소장으로 재직하는 동안 가담했던 주요 사건들 중에서 그가 반대의견을 통해 판결성향을 비교적 명확하게 드러낸 대표적 사건들을 정치, 경제, 사회ㆍ문화 분야별로 선별하여 정성적으로 분석한다. 그리고 이강국 헌법재판소장이 제3기 헌법재판소장으로 재직한 6년 동안 관여했던 모든 전원재판부 사건들을 대상으로 한 정량분석도 행한다.
판결성향의 정량분석에는 사법적극주의 v. 사법소극주의의 분석틀만을 사용하였고, 정성분석에서는 사법적극주의 v. 사법소극주의, 사법진보주의와 사법보수주의, 문언주의 v. 비문언주의, 판결을 통해 사회적ㆍ경제적 약자 및 소수자의 권리를 신장시키려는 입장을 보였는지 여부, 판결을 통해 청구인의 기본권 ‘보장을 확대’하려 했는지 혹은 반대로 청구인의 기본권 ‘제한을 옹호’하려는 입장에 섰는지의 다섯 가지 분석틀을 사용하였다.Chief Justice Kang-Kuk Lee led the fourth Korean Constitutional Court which worked from the year of 2006 to 2012. The fourth Korean Constitutional Court made many influential constitutional decisions to Korean society based on the foundations which had been laid by the Korean Constitutional Courts in the previous terms for eighteen years.
This paper aims at analyzing the judicial inclination of the Chief Justice Kang-Kuk Lee who led the fourth Constitutional Court from 2007 to 2013 in Korea. He had been a elite judge for 28 years before he was appointed as a Justice of Korean Supreme Court and later was appointed as a Chief Justice in the fourth Korean Constitutional Court in the year of 2007 by the President Moo-Hyun Rho.
To achieve the aim, this paper examines the life path and the judicial career of the Chief Justice Lee before he was appointed as a Chief Justice in the Fourth Korean Constitutional Court. Then, I will qualitatively analyze his opinions through the four major cases representing political, economic, social and cultural fields. I will also quantitatively analyze his whole opinions in 2,512 cases based on the statistics. For the analyses of the statstics, the analytical frames such as ‘judicial activism v. judicial passivism,’ ‘judicial progressivism v. judicial conservatism’ and ‘textualism v. non-textualism’ will be applied.
