규제는 그 방식과 내용과 무관하게 사인의 자유로운 활동을 제한하는 국가의 작용의 형식이다. 규제를 설정하거나 강화하는 경우에는 우선적으로 기본권 제한과 관련한 헌법적 원리가 지배된다. 규제와 관련한 논의는 자유로운 영업활동의 보장, 재산권 보장과 이에 대한 국가의 개입과 제한과의 관계로 볼 수도 있다. 그러한 의미에서 국가로부터의 간섭을 최소화하고 기업의 자유와 자본의 세계화를 주장하던 신자유주의의 등장 시기와 규제개혁, 규제영향평가논의의 시기가 거의 맞물려 있다는 것은 우연이 아니다. 신자유주의 이론은 별론으로 하더라도 국가가 사인 및 기업의 활동에 개입하기 위해서는 법치국가, 민주주의, 평등 원칙과 같은 헌법적 정당성을 가진 법률에 그 근거를 둔 구체적이고 개별적인 내용을 가지면서 집행의 측면에서 최적의 효율성을 가진 수단을 사용하여야만 한다.
규제는 국가 및 지방자치단체가 공익의 실현과 이를 통한 구성원의 자유와 권리를 보호하고 보장하기 위한 공적 수단이다. 규제는 과거 모든 국가에서 다양한 형태, 근거로 있어왔다. 그러나 첨단기술, 새로운 위험의 발생, 위험의 세계화 등 점점 복잡해지고 있는 현대국가는 사회영역에 더 많은 개입을 할 수 밖에 없다. 어떠한 사인도 자신의 이익에 봉사하면서 동시에 공익을 실현할 수는 없으며, 이를 기대할 수도 없다. 결국, 규제의 불가피성을 인정하는 전제아래 피 규제자와의 관계에서 규제의 합리성, 규제의 적정성, 규제의 지속성, 규제의 효율성 등을 면밀히 검토하고 개선해 나가는 것이 규제 입법자의 입법태도라고 생각한다.Regulation is a form of state action that restricts individual freedom, regardless of its contents and methods. Creation and reinforcement of regulation is necessarily ruled by Constitutional principles regarding restriction of Fundamental rights. Discussing regulations primarily addresses guarantee of free enterprise, property rights, and restrictions placed upon these liberties. Therefore, it is not a coincidence that issues on regulatory reform and regulatory impact assessment were raised along with the advent of neoliberalism, which proposes minimal state interference would further enhance freedom of enterprise and globalization of investment. Apart from the theory of neoliberalism, it is imperative that a state regulate individual and private enterprises on the basis of specific laws of constitutionally legitimate principles such as rule of law, democracy, and equality, while adopting the most efficient methods in terms of applications.
Regulation is a public method with which state and local government pursue to serve public interest and therefore guarantee freedom and rights of their members. These regulations took a wide range of forms with various basis. However, the ever-more complicated contemporary state, which is characterized by high technology, creation of new dangers of risks, and globalization of risks inevitably turns to more interventions in social sectors. There is no fulfillment of public interest for an individual while pursuing their private interest at the same time, and it is also unreasonable to make such claims. Thus, under the premise that regulatory legislations are unavoidable, legislators of regulations must aim to deliberate thoroughly and improve the rationality, sustainability, and efficiency of regulations.
