기술의 발전으로 과거에는 사회에 등장하지 않았던 사이버머니와 같은 지급수단이 이용계약과 함께 등장하여 활용성 측면에서 폭발적으로 성장하고 있어서 사회구성원들에게는 금전과 유사한 재산적 가치를 인정받고 소유권의 객체로 인식되고 있다.
사이버머니의 법률관계를 채권적 법률관계로 본다면, 발행자가 마련한 약관의 내용이 약관규제법에 명백히 반하지 않는 이상 그에 구속되므로 이용자의 이익과 사이버머니의 합리적인 생태계 조성을 위하여 별도의 법적 규율이 요청된다. 그 방안으로 「전자상거래 등에서의 소비자보호에 관한 법률」이나 「콘텐츠산업진흥법」 등의 개별 법률에 이용자 이익을 제한하거나 침해하는 발행자의 행위의 금지조항을 마련하는 것도 고려될 수 있겠지만, 사이버머니의 충전과 이용의 법률관계를 약관에 의한 무명계약이 아닌 매매의 법률관계로 다루고 사이버머니를 물권의 객체인 물건으로 본다면 기존의 해석론으로도 대응이 가능하다. 물권은 자유로운 처분성을 가지므로 발행자가 마련한 약관에서 발행자로의 환금이나 이용자 간 양도를 제한하더라도 물건의 특성상 제3자에게 사이버머니를 자유로이 처분할 수 있는 것으로 이론구성이 가능하기 때문에 환금성과 양도성을 간접적으로 확보할 수 있어서 이용자 스스로 자유로운 양도를 통하여 재산적 가치를 보전 받을 수 있고, 이용자의 사망 시 상속의 문제도 해결이 용이하다.Due to technological development, a new means of payment such as cyber money has appeared along with use agreements; its usage is increasing explosively and its property value is being recognized as similar to money by members of the community.
If legal relation of cyber money is viewed as claim legal relation, it shall be subject to the provisions set by the issuer; therefore, a separate set of legal regulations is required for benefit of users and in order to create reasonable ecosystem for cyber money. A provision prohibiting issuers from restricting or infringing upon users’s benefit may be added to Act on Consumer Protection in the Electronic Commerce Transactions, etc or Contents Industry Promotion Act; however, if legal relations for charging and using cyber money are treated as trade legal relations instead of nichtbenannter Vertrag in accordance with the provisions and if cyber money is viewed as an object of a real right, the issue may be dealt with based on the existing theory of interpretation. A real right may be disposed freely; therefore even if the issuer establishes a provision that restricts conversion of cyber money into cash through the issuer or transfer of cyber money between the users, the users may dispose their cyber money to a third party at their will due to the nature of the object. As a result, cashability and transferability can be assured indirectly allowing users to preserve the value of their property through unrestricted transfer, and also the issue of succession of property in case of the user’s death may be solved easily.
