산업안전보건법은, 여타의 행정법률들과 마찬가지로, 그 내용 가운데 주요 조항을 위반한 사람에 대한 벌칙규정을 제9장, 제66조의2 이하에 마련해 놓고 있다. 이 중 2006년 새로 신설된 제66조의2는 통상적인 행정벌칙 규정과는 달리 일정한 의무위반 행위에 대해 ‘근로자의 사망’이라는 결과의 발생을 요건으로 하여 7년 이하의 징역 또는 1억 원 이하의 벌금이라는 가중된 형벌을 부과한다. 그런데, 이 조항은 애초의 기대와는 달리 현실에서 별로 활용되고 있지 못하다. 입법 이후 10여년이 지난 2016년 현재까지 이 조항의 위반이 인정된 대법원의 판례는 단 2건에 불과하다.
필자는 이 규정에 대한 위와 같은 (형사)사법 소극주의를 지적함과 동시에 이 조항에 대한 새로운 해석론을 시도해 보고자 한다. 여기에는 이 조항의 법적 성격, 즉 이것을 일반적인 경우와 같이 고의의 기본범죄와 중한 결과가 결합된 결과적 가중범으로 볼 것인가 아니면 다른 어떤 해석이 가능한가 하는 문제와 함께 이 범죄의 주체와 객체에 대한 문제가 포함된다. 범죄의 주체에 대한 문제에서는 다시 두 가지, 즉 이 조항이 양벌규정을 거치지 않고‘법인’ 사업주에게도 곧바로 적용될 수 있는가 하는 문제와 사업주가 아닌 행위자도 이 조항의 처벌 대상이 되는가 하는 문제를 검토한다. 범죄의 객체에 대한 문제는 역시 판례가 이 조항의 ‘근로자’를 사업주와 ‘실질적인 고용관계가 있는’ 근로자로 한정하고 있으므로 이를 좀 더 넓혀 보아야 하지 않는가 하는 점과 함께 수급인의 근로자에 대한 도급사업주의 책임이 이 조항에 포함되어야 한다는 점을 지적한다. 이와 같은 시도가 산업안전보건법의 관련 조항을 체계적으로 해석하고 특히 제66조의2와 같은 형벌 규정의 적용 가능성을 높여 이 법의 제정 취지를 현실에서 조금이라도 더 실현하고자 하는 것임은 말할 나위도 없다.The Article 66-2 of the Occupational Safety and Health Act was enacted in 2006. This clause says “A person who has caused the death of a worker in violation of Article 23 (1) through (3), or Article 24 (1) shall be punished by imprisonment for not more than seven years or a fine not exceeding 100 million won.” The experience of the past ten years, however, shows that the Criminal Justice Offices (including the Court) have hardly applied this clause.
This essay, therefore, aims to develope a new interpretation about the Article 66-2. The interpretation is made up of three points. Firstly, about the legal requirements of the Article 66-2, this essay says it does not necessarily ask the actor’s intention. Negligence also can make the actor a criminal. Secondly, on the subject, this Article can be applied directly to the corporation itself, not through the Article 71 which is the joint penal provision related with both the actor and the corporation. Thirdly and finally, the object of the Article should be broadened to include both the laborers in special types of employment and the workers employed by the first employer’s contractor.
