87년 체제의 기본법인 87년헌법을 개정하자는 논의가 본격적으로 진행되고 있다. 그러나 87년 체제의 역사사회적 본질이나 제도요소의 특질에 대한 신중하고도 실증적인 분석과 평가는 도외시하면서 정략적이거나 막연한 이미지에 의존한 개헌론은 오히려 개악으로 흐를 수 있다는 점을 유의해야 한다.
이 글은 이러한 문제의식에 입각하여 87년 체제가 다양한 차원에서 논의될 수 있다는 점에서 출발하여 87년 체제, 특히 정치체제의 헌법적 차원에서 개혁의 필요성이 있는 부분이 무엇인지를 민주공화주의 원리에 입각하여 견제적 민주주의를 강화하여야 한다는 관점에서 제시하려는 목적을 가지고 있다.
우선 87년 체제, 특히 정치체제는 정부형태를 비롯한 헌법상의 제도요소 외에 정치관계법 등 입법상의 제도요소와 정치문화적 요소에 의해 종합적으로 이해되어야 한다는 주장을 편다. 그 결과 정치권 중심의 개헌론에서 중점을 이루고 있는 5년 단임제 정부형태 개헌론이 과장되고 왜곡된 헌법분석과 진단에 의존하고 있음을 논증하고 오히려 국민주권의 실질화를 위한 정치관계법의 정비를 헌법적 차원과 입법적 차원에서 우선적으로 추진할 필요성을 강조하는 한편 정치권력의 통제에 유용한 사법권력과 감사제도가 현행헌법하에서 민주공화적 원리하에 정비되어 있지 못한 점을 개선해야 할 필요성 또한 강조하고 있다. 더불어 정치체제의 위기가 반복되는 것은 중앙집중적 권력구조하에서 권력기관의 일탈에 의한 부정적 영향이 국가공동체 전체에 미치는 강도가 증폭되고 있다는 점에 그 원인이 있음을 지적하고 획기적 지방분권 또한 개헌을 통한 정치개혁의 전제조건임을 주장한다.
결론적으로 헌법제도의 미시적 개량에 집중한 개헌보다는 헌법제도와 하위입법제도 및 정치문화의 유기적 결합을 전제하여 민주공화주의원리에 부합하는 국민참여개헌, 국민의 정치적 주권을 실질화하는 국민주권강화개헌만이 촛불시민항쟁으로 현직대통령의 권력남용을 단죄한 시대정신에 부합할 것이라는 점이 강조된다.Recently, a movement for constitutional amendment, which calls for a comprehensive revision of the Constitution of 1987, becomes one of main agenda in Korean politics. However, it is doubtful that this movement is backed up by scientific and positivist analyses and prudent evaluation of current constitutional arrangements. The author assumes that the movement, especially initiatives driven by politicians, are motivated by strong partisan or self-interested motivations focussed upon the empowerment of the members of the legislature. Needless to say, any constitutional reform should be based upon the cautious and objective evaluation of not only socio-historical backgrounds and spirits but also institutional elements of existing constitutional arrangements.
Assuming that the 1987 regime is a multi-dimensional one which cannot be understood by simple and superficial observations of current political realities, the author argues that any constitutional reform, especially the reform of governmental structures, should be designed by a multi-dimensional comprehensive approaches covering not only constitutional forms of governments but also legislative political reforms of the election system and political party system with peculiarities of Korean political culture. In particular, it is stressed that the current constitutional crisis cannot be mainly attributed to institutional arrangements of the 1987 Constitution but to politicians’ ignorance or violation of its principles and procedures. From this viewpoint, this article aims to look into what should be reformed from the perspectives of ‘contestatory democracy’ based upon the principles of a democratic republic. The author argues that the current constitutional crisis can be cured by more strengthened checks and balance system in constitutional and statutory arrangements. The required reform includes the intensified devolution of excessively centralized political powers, the election reform towards proportional representation and liberalization of political expressions and associations through legislative reforms of the election law and the political parties law, the decentralization of judicial administration and institutional independence of audit and inspection system.
In conclusion, the author points out that above all of the substantive reform agenda, the most important elements leading the constitutional reform movement to its success will be the issues like how to reflect the peoples’ will in this field and how to enable their participation in the constitution-making.
