A contract for the carriage of goods by sea, receipt of goods, and document of title of the bill of lading(B/L) play significant roles in facilitating international trade between countries. Considering the development of container and high speed vessels, a cargo ship arrives at the destination before the consignee receives the B/L in short distance sea shipping. In order to solve this problem, the shipper surrenders the original B/L to the carrier at the place of issue instead of sending them to the place of arrival. The shipper, carrier, contract carrier, and actual carrier open the surrender B/L which bears “surrendered” on the right of the B/L. This is not the original B/L and is an evidence for only a carriage contract and receipt of goods. The subject carriers can’t invoke the carrier’s defense and limit. The shipper, carrier, contract carrier, and actual carrier must open the surrender B/L which bears “surrendered” on the original B/L.
