메이지시대 일본에서 추진된 부국강병·경제성장만을 위한 근대화는 개인을 발견해내고 국가가 개인의 기본권을 보장하기 위하여 존재한다는 서구적 근대의 다른 속성을 도외시하였다. 그리하여 법치주의를 행정권에 대한 법적 통제라고 이해하지 않고, 거꾸로 행정권의 명령에 복종하는 것이 법치주의라고 이해하였다. 그리하여 왜곡된 권력분립론에 의한 사법권의 한계만 강조하는 행정소송체계를 형성하고, 이러한 행정우위의 발상 하에서 행정재판제도가 설계되었다. 이러한 논리는 행정에게는 활동의 자유를 보장하고 국민에 대해서는 재판상의 보호를 거부하는 것으로 귀결된다. 그런데 식민지 조선에서는 위와 같이 불완전한 행정쟁송체계마저도 시행하지 않았다.
해방후 우리나라는 일본의 행정소송법체계를 모방하고 그 해석론을 수입하였다. 이렇게 왜곡된 근대화의 영향 아래에 만들어지고 발전되어온 우리나라의 행정소송법체계를 반성적 차원에서 성찰하고 행정소송법의 현재적 존재의의를 직시하여, 그에 맞게 작동할 수 있는 시스템을 구축하는 것이 오늘날 우리의 과제가 된다.The idea of modernization solely for the purpose of economic growth, which was promoted in Japan during the Meiji era, ignored other characteristics of Western modernity that focused on discovering individuality and the state existing to guarantee individual basic rights. Hence, the rule of law was understood as accepting the rule of executive powers rather than legal control of the executive powers. Based on this distorted view of separation of powers, an administrative litigation system emphasizing the limitations of judicial powers was established, and an administrative trial system was designed under the idea of such administrative superiority. This resulted in a guarantee of freedom for the administration and less judicial protection of ordinary citizens. But Colonial Joseon did not even implement this imperfect administrative litigation system.
After liberation, Korea imitated the administrative litigation system of Japan and imported its interpretations. We need to undertake the task of reflecting on the administrative law system of Korea which has been formed and developed under the influence of such distorted modernization, and comprehend the present significance of administrative litigation laws to build a coherent system.
