이 논문은 교육에 관한 준헌법으로 평가받는 교육기본법을 헌법정신의 관점에서 그 전개 과정을 평가하고 향후 개정 방향을 논의한 것이다. 이는 1998년 이 법 시행 이후 20년 동안의 16차 개정에 대한 평가이며, 헌법정신의 구현 수준에 대한 확인 과정이다.
판단의 준거로서 헌법의 교육조항에 대한 학계의 학설을 분류하여 정리하였고 이를 기초로 헌법과 교육기본법과의 관계 일반론을 모색했다. 그 목적은 교육기본법이 교육법과 제도의 가이드라인 법으로서 준헌법적 위상을 가질 수 있도록 하는 데 있다.
교육기본법이 갖는 역사적 의의는 교육에 있어서 국민의 권리와 의무, 그리고 국가 및 지방자치단체의 책임 관계를 설정하였다는 점이고, 교육당사자 개념을 도입하여 국민의 교육기본권 실현의 관점에서 역할분담을 명확히하였다는 것이다. 그러나 학습자 중심의 권리보호에 강조점을 둔 것은 사실이나 학습의 자유 보장에 대하여는 근본적인 과제를 안고 있고, 보호자의 학교운영 참여 역시 가변적이다. 이에 비하여 포괄적인 지도·감독권을 갖는 국가와 지방자치단체는 학교설립자라는 이중적 당사자로서 여전히 교육 법률관계에서 우위를 차지하고 있는 것이 현실이다. 국가와 지방자치단체의 의무로서 규정된 각종 교육진흥 시책의 수립 및 시행은 교육부가 주도하여왔고, 이로 인한 잦은 교육기본법 개정은 각 정부의 교육정책 홍보법이라는 비평을 받는 원인이 되었다.
쟁점 해소를 위한 개정에 대하여는 헌법 31조 1항과의 조화를 위한 학습권 규정의 보완을 비롯하여 총칙과 교육당사자, 그리고 교육의 진흥 영역에 있어서 개정 방안을 모색해 보았고, 정책홍보법 한계를 벗어나기 위한 입법 기술상의 과제와 일본과 대만과의 비교교육법 측면에서 개정의 시사점 등을 모색해 보았다.The purpose of this study is to initiate amendments of the Fundamental Law of Education(hereinafter referred to as FLE). The basic viewpoint of analysis is based on spirits of The Constitution(Article 31; Education). For this research purpose, this article analyzed advanced research about the FLE, scholar’s theories on the Right to Education, Constitutional Court precedents, foreign FLE’s examples(Japan and Taiwan), and the other amendments proposed by 20th the National Assembly(2016-2020).
This article composed of five chapters; The problem situation, The tendency of advance study and the spirit of the Constitution as a basis for judgment, Characteristics of the FLE and comparison with foreign cases, The direction of law reform for solution of the issues, and The conclusions. The seriousness of the problem is said to have been revised 16 times in the past 20 years, submitted 17 amendments in the past two years.
The purpose of this FLE is to provide for the rights and duties of citizens and the obligations of the State and local governments on education, and prescribe an educational system and fundamental subjects for its operation. The FLE regulated the relation of the rights, duties, responsibilities among the parties to an education(Students, Parents, Teachers, School-founder and manager, Nation and Local governments)
As a conclusion, This article suggested the four tasks about the FLE. Firstly, The Right to Learning should be re-defined as the fundamental rights to eduction. The FLE should be amended to ensure the spirit of the Constitution. That means harmony with Article 31 of the Constitution. The FLE should be recognized as a ‘Education Constitution’, not the act on promoting policies. Finally, The cases of Japan and Taiwan have given many indications on the principle of role division between the state and local authorities, and valid guarantee of the FLE.
