대학 교수의 근로자성 여부를 다투기에 앞서 분명한 점은, 대학의 구조조정 과정에서 학내 참여 민주주의 원칙이 관철되어야 한다는 사실이다. 그러나 아직 이러한 점이 제도적으로나 관행적으로 현저히 미흡한 실정이다. 조직의 운영방향을 그 조직 구성원의 총의로 결정하도록 한 민주주의 원리는 기업에서는 사업장 민주주의원리로, 대학에서는 대학민주주의원리로서 그대로 구현되어야 한다. 대학의 경우 그 중심에 전체 교수의 대표체로서 대학평의회가 자리하고 있다. 독일은 일찍이 사업장 단위에서 종업원평의회 체계를 구축하고, 사업장 내 참여를 통한 민주적 의사결정체제를 마련해 두었다. 이러한 독일식 종업원평의회 체계를 염두에 두고, 대학내 대학평의회 체계의 구축이 필요하다.Universities must have their own system of order autonomous and respected externally. Therefore, as a member of the university community, professors and staff must be governed by unique discipline within the university. It is the “agreement” between the university council and the president (the university headquarters) that should be respected first among all forms of discipline in the university. No one's interference can be affected here, and this is the ‘university autonomy principle’.
The decision to operate the university should be an intention of the university members. It is urgent to realize the institutional democratization of the decision-making system of universities from the question of who becomes president. By institutionalizing university democracy as a school order, we will be able to guarantee the democratic operation of the university regardless of details such as the election of the president or the qualifications of the staff of the position. In this regard, the professors' organization, which is the organization of all professors, can be regarded as an axis of university democracy as a subject that expresses the opinions of the professors.
Transparent information sharing and consultation between university professors and university administrators around university restructuring is the only way to prevent unnecessary costly disputes while enhancing the effectiveness of university restructuring. One-way restructuring only causes confusion. The democratization of the university means the participation of the members soon. The problem-solving method of restructuring should also be democratic.
