본 논문은 개업공인중개사가 중개업무를 수행함에 있어 가져야 할 주의의무가 어느 정도인가에 대하여 판례를 중심으로 살펴보고 있다. 개업공인중개사의 주의의무위반과 관련하여 개업공인중개사와 중개의뢰인 사이에 발생하는 법적 분쟁은 권원에 관한 것, 권리의 하자에 관한 것, 법령상의 제한에 관한 것 및 그 밖의 것등으로 나눌 수 있는데 이들 각각에 대하여 검토하고 있다.
개업공인중개사가 중개의뢰를 받고 중개 관련 업무를 처리할 때의 주의의무에 대하여는 직접적으로 공인중개사법의 업무상의 금지사항 및 의무사항을 들 수 있고 이 외에 일반적인 주의의무로서 민법 제681조에 따른 선량한 관리자로서의 주의의무가 있다.
개업공인중개사에게 업무상 일반적인 주의의무를 인정하는 근거로는, 중개의뢰인은 일반적으로 법률 또는 부동산문제에 대해 전문지식이 부족할 뿐 아니라 복잡한 공법상의 제한사항 등이 관련되어 있는 부동산 거래문제에 대해 거의 문외한이라 할 수 있기 때문에 전문적인 지식과 거래의 경험을 갖춘 개업공인중개사를 신뢰하여 부동산매매 등의 중개를 의뢰하는 것이라는 점에서 찾을 수 있다. 따라서 개업공인중개사에게 일정한 주위의무를 부과하는 것이며 이를 위반하였을 때에는 중개의뢰인에 대한 손해배상책임을 부담하도록 하는 것이다. 판례는 중개의뢰인의 과실 여부를 인정함에 있어서 그 근거로서 과실상계의 법리를 들고 있으나, 중개의뢰인과 개업공인중개사의 과실을 동등하게 볼 수 있느냐와 중개의뢰인의 과실인정의 기준의 애매함 등을 고려할 때 위 판례의 태도는 재검토되어야 한다.In this paper, we looked at case law theory that where the brokerage firm does not distinguish whether there is an intermediary brokerage relationship with an intermediary client. These legal disputes were reviewed and classified as matters concerning the issue of rights, defects of rights, restrictions on laws and regulations, and other important matters.
In order to judge whether or not the practitioner has violated the obligation to pay attention when handling brokerage related inquiries received from intermediary clients, In addition to the prohibitions and duties imposed on the work prescribed by the Certified Public Accountants Act, it can be seen that the duty of care as a good manager under Article 681 of the Civil Act is very important as a legal basis. The broker is generally not clear about legal issues and real estate matters, but also because of the complexity of the public transaction restrictions on real estate transactions, Trustworthy practitioner who has experience of knowledge and transaction, and commission brokerage such as safe property sale. Moreover, it is based on the idea of paying the corresponding brokerage fee. Therefore, it is reasonable to assume responsibility for damages for the intermediary client when the practitioner broke the obligation of circumstance. However, the judicial order of the comparative negligent settlement seems to need to be reviewed in order to recognize the fault of the intermediary client.
