헌법재판의 민주적 정당성은 입헌민주주의의 근본과제이다. 이 글은 민주적 정치과정의 안정적이고 효과적인 작동과 시민의 자율성의 근간이 되는 인권의 보장에 기여하는 역할 또는 기능을 담보로 헌법재판의 민주적 정당성을 인정하는 입장을 취한다.
헌법재판의 기능적 정당화를 위해 이 글에서의 또 다른 시도는 입헌민주주의를 공화주의 정치철학에 기초하여 재해석하려는 것이다. 전통적으로 공화주의는 헌법재판의 민주적 정당성에 회의적이지만 공화주의 정치철학에 의하더라도 헌법재판이 입헌민주주의의 요소로 기능할 수 있는 여지가 있다는 주장이다. 입헌민주주의를 공화주의의 비지배적 자유의 개념과 이에 수반되는 실질적 평등의 가치 및 이를 실현하기 위한 국가의 의무에 관한 명제는 헌법재판과 마찬가지로 원칙적으로 공화주의와 친화적이지 아니한 정당제도에 대한 적극적 헌법재판이나 사회경제정책에 대한 적극적 헌법재판을 정당화하는 핵심논거로 활용된다.
한국의 정치체제 자체의 비민주적 구성과 작동은 민주적 정치과정의 효과적 구축을 위해 국가의 억압적 규제하에 있는 정당법제에 대한 적극적 헌법재판과 사회적 약자의 비지배적 자유를 제도적으로 보장하기 위한 사회경제정책에 대한 적극적 헌법재판을 정당화하는 한국적 특수조건을 제공한다.
헌법재판의 민주적 정당성에 대한 기능적 접근법을 제공하는 이 글이 짧은 역사에도 불구하고 입헌민주주의를 발전시키는데 중요한 역할을 해 온 한국의 헌법재판소가 그동안의 시행착오를 극복하고 민주적정당성을 충족하는 입헌 민주체제의 기본요소이자 헌정의 안정적이고 민주적인 발전을 위한 조정자로서의 역할로 자리매김하기 위해 소극적 헌법재판과 적극적 헌법재판의 필요성과 조건에 대해 숙고하는데 기여하게 되길 기대한다.
Establishing the democratic legitimacy of constitutional adjudication is a fundamental task of constitutional democracy. This paper takes the position that the democratic legitimacy of constitutional adjudication can be recognized for its roles or functions of contributing to the guarantee of human rights, which is the basis of the stable and effective operation of democratic political processes and civic autonomy.
This paper will also attempt to reinterpret constitutional democracy based on the political philosophy of republicanism in order to justify the functions of constitutional adjudication. While republicanism has traditionally viewed the democratic legitimacy of constitutional adjudication with skepticism, constitutional adjudication may still function as an element of constitutional democracy even within the standards of the political philosophy of republicanism. The concept of liberty as non-domination and the value of substantive equality, as well as the state��셲 obligation to materialize substantive equality are used as key grounds for justifying active constitutional adjudication on the political party system, which, in nature, does not go really well with republicanism, or on social and economic policies.
Further, the fact that the political system of the Republic of Korea is organized and operates in an undemocratic manner creates a unique context in Korea which justifies active constitutional adjudication on 1) the laws on political parties, which are under the suppressive control of the state for the effective establishment of democratic processes, and 2) the socio-economic policies designed to institutionally guarantee ��쁫iberty as non-domination��� of social minorities.
The Constitutional Court of Korea has played an important role in advancing constitutional democracy despite its short history. As this paper aims to provide a functionalist approach towards the democratic legitimacy of constitutional adjudication, it is my sincere hope that this work can help the Constitutional Court in contemplating the necessity and the required conditions for passive constitutional adjudication and active constitutional adjudication respectively. This would allow the Court to overcome past errors and establish itself as a fundamental element of constitutional democracy that has democratic legitimacy and as a coordinator for the stable and democratic advancement of constitutional government.
