오랜 논의 끝에 법조일원화를 위한 법관 임용방식의 변화가 도입된 것도 이미 5년이 넘었다. 그러나 법조일원화에 대해 보완을 요청하는 목소리도 적지 않다. 그동안 법조일원화를 통해 나름의 변화가 계속되고 있지만, 그 변화의 가시적 성과는 크지 않고, 오히려 역효과를 우려하는 목소리들이 점점 커지고 있다.
법조일원화를 통해 기대했던 것은 크게 세 가지로 정리될 수 있다. 첫째, 변호사 중에서 판사를 임용하도록 함으로써 판사임용이 사법시험이나 변호사시험 등의 성적위주를 벗어나 법조인으로서의 능력을 종합적으로 평가할 수 있다는 점, 둘째, 경력을 가진 변호사들이 판⋅검사에 임용됨으로써 법관의 다양성과 전문성을 강화하고, 이를 사법절차에 반영할 수 있다는 점, 셋째, 법원의 엘리트주의를 완화하고 국민에 대한 사법서비스를 강화할 수 있다는 점이 그것이다.
이를 달성하기 위해 현재의 법관 임용방식의 개선과 맞물려 법관의 처우나 보조인력 등과 관련한 개선과제들도 비중 있게 검토되어야 할 것이다. 물론 이러한 문제들은 법조일원화에 한정된 문제들은 아니며, 법원의 기능 제고를 위한 문제로 오래전부터 계속 논의되어 왔던 것들이지만, 변화된 여건 속에서 그 의미와 비중이 더욱 높아졌다.
법조일원화를 통한 법관 임용방식의 변화는 그 자체로서 완성되는 것이 아니라, 사법부 전체의 개혁과 맞물려 사법작용의 객관성과 공정성, 그리고 경제성과 실효성의 향상으로 연결될 때 비로소 성공적으로 정착되었다고 평가될 수 있을 것이다.After a long discussion, changes in the appointment of judges for unification of the legal profession have already been introduced for over five years. What we expected from the unification of the legal profession can be roughly classified into three kinds.
First, by appointing a judge in the attorney's office, judge appointment can be evaluated as a judge's ability in a comprehensive manner out of achievement such as judicial examination or lawyer examination. Second, recruiting experienced lawyers to judges can strengthen judicial diversity and professionalism and reflect them in judicial procedures. Third, it can alleviate the elitism of courts and strengthen judicial services for the people.
In order to achieve this, it is necessary to review the improvement issues related to the judicial process and assistant manpower in conjunction with the improvement of the current judicial appointment method.
Of course, these problems are not limited to the unification of the legal profession, and they have been discussed for a long time as a problem for improving the function of the court. However, its significance has increased in the changing circumstances.
The change in the way of appointing a judge through unification of the legal profession is not solely accomplished. It can be evaluated that it has been successfully settled when it is connected with the objectivity and fairness of judicial action, and the improvement of economic efficiency and effectiveness in conjunction with the reform of the entire judiciary.
