말레이시아의 이슬람 금융은 무슬림의 의무인 하즈를 위한 예금의 필요성을 충족하기 위해 1960년대 시작하였다. 이후 말레이시아는 1980년대와 1990년대의 법제도적 정비 및 기존 서구식 금융제도와의 이원적 체제 구축을 통해 명실상부한 국제적 이슬람 금융 허브로 자리매김하게 되었다.
이슬람 은행의 지배구조가 서구식 은행의 지배구조와 확연히 다른 점은 이른바 샤리아 지배구조가 있다는 점이다. 샤리아 지배구조는 샤리아 준수에 관한 효과적이며 명확하고 독립적인 일련의 기관 및 조직 시스템을 말하여, 이슬람 은행이 준수해야 할 최우선 사항이다. 샤리아 지배구조를 제도적으로 정착하고 운영하기 위해 말레이시아 중앙은행은 일련의 가이드라인을 제시하여 이슬람 은행뿐만 아니라 이슬람 은행업을 하고자 하는 서구식 은행을 관리 통제하고 있다.
이슬람 은행이 샤리아 적합성을 충족하면서 운영하고 있는지의 여부는 샤리아 지배구조가 해당 은행에 잘 구축되어 운영되는지 여부에 달려 있다. 그러나 샤리아 그 자체도 실질적ㆍ우선적으로 개별 은행의 샤리아 자문기구와 중앙은행의 국가 샤리아 자문위원회에서 판단 근거 혹은 기준으로서 역할을 하고 있다. 이처럼 말레이시아는 성문법과 샤리아의 상호 작용을 통해 이슬람 은행과 이슬람 은행업을 하는 금융기관에게 적절한 샤리아 지배구조를 제시ㆍ운영하도록 하여 샤리아를 준수하도록 하고 있다. 또한 말레이시아 개별 이슬람 은행 내에 자체 샤리아 자문기구는 있지만, 이와 더불어 모든 이슬람 은행업과 타카풀 문제에 대해서는 국가 샤리아 자문 위원회가 최종적으로 판단하고 해결하고 있기 때문에 이슬람 은행업의 샤리아 적합성에 대한 통일성과 명확성을 기할 수 있다.
나아가 말레이시아 정부는 이슬람 은행에의 직접 투자 혹은 설립 등과 같이 하향적ㆍ직접적 관여 보다는 민간 기업이 스스로 이슬람 은행업에 진입하거나 운영할 수 있도록 제도적ㆍ법률적 뒷받침을 하고 있다. 이른바 이슬람 금융시스템과 서구식 은행시스템이 병존할 수 있는 말레이시아의 이중 은행 시스템은 말레이시아가 이슬람 금융의 허브이자 견인적 역할을 하게 하는 원동력이다. 또한 말레이시아의 이슬람 금융은 녹색금융을 선도적으로 운영하기 위해 유연하게 샤리아를 적용하고 있을 뿐만 아니라 실무적으로 SRI 수쿠크 발행하는 등 지속적으로 이슬람 금융상품을 개발하고 있다.Islamic finance expanded throughout Malaysia’s rapid economic development in the 1980s and early 1990s. In order to become a global hub of Islamic finance, the Malaysian government has made a number of key interventions in Islamic finance through: regulatory reforms reducing ambiguity in Islamic financial services, enhanced research on Sharia matters, development of innovative instruments, and creation of new instutions. Among them, Malaysia’s conventional laws, i.e. the IBA 1983, the BAFIA 1989 and the Central Bank of Malaysia Act 2009, have a major role to govern the operation of the Islamic banking business. Thanks to the Interest-Free Banking Scheme in 1993, Malaysia’s conventional banks opened up Islamic ‘windows’ to offer Islamic financial products. This scheme offered the most cost-effective and efficient way to disseminate Islamic banking on a national-wide basis.
Matters of substance that govern the Sharia compliance of the banks’ products and services are left to the Sharia Advisory Boards of each bank and the National Sharia Advisory Council(NSAC) of the Central Bank. Malaysia’s comprehensive regulatory framework with regard to Islamic banking seeks to ensure proper Sharia governance within Islamic financial institutions. Uniformity and certainty in Sharia governance for investors and other stakeholders is maintained through NSAC that deals with all the Islamic banking and Takaful matters in Malaysia. So, courts and arbitrators are required to refer to NSAC rulings in any dispute pertaining to Islamic financial business.
Through this paper, I would like to propose to provide its basic theory of Islamic bank in Malaysia to our government and companies which are interested in Islamic finance, especially Islamic bank.
