본고는 메이지 초기 도쿄에서의 외국인 관리 문제를 청국인에 초점을 맞추어, 청국 영사관이 설치되기 전까지 시행된 ‘재류청국인민적패규칙(在留淸國人民籍牌規則. 이하, ‘적패규칙’으로 약칭함)’의 운용 사례를 검토하였다. 도쿄는 개국 일본의 유일한 ‘개시장’이었다. 개시장은 원칙적으로 상업 활동을 위한 외국인의 일시적인 거주〔逗留〕만을 인정하고 외국 무역선의 입항을 허가하지 않았다는 점에서 개항장과 구별된다. 따라서 개시장 도쿄는 다른 개항장과 달리 ‘무역항’으로 성장할 수 없는 한계가 있었으며 이에 따라 외국인 거류지 또한 협소한 범위를 벗어나지 못했다. 이 같은 한계 속에서 도쿄 재류외국인의 존재 양상도 다른 개항장과는 다른 모습을 보였다. 외국인 인구 규모 자체는 작았으나 정치, 외교 중심지인 도쿄에 근대화 정책을 추진하기 위해 초빙, 고용한 ‘고용 외국인’이 집주하게 된 것이다. 이러한 고용 외국인의 존재는 당시 재류외국인의 절반을 차지하던 청국인에게도 나타나는 현상이었다. 도쿄에서 ‘적패규칙’에 따라 적패를 발급받고 수수료를 제출한 청국인 가운데 상당수가 미쓰비시에 고용된 청국인이었다. 흥미롭게도 이들에 대한 적패 발급 수량은 당시 도쿄 재류 실제 청국인 수를 훨씬 상회하였다. 이는 미쓰비시에 고용된 청국인들이 실제로 도쿄에 재류하는 것이 아니라 증기선에 승선하여 일했기 때문이다. ‘적패규칙’이 실제 거주하지 않는 청국인까지 관리 대상으로 하여 엄격히 시행된 것을 확인할 수 있다.
한편, ‘적패규칙’은 재류 청국인의 신분을 상, 하 등급으로 나누어 각각 다른 수수료를 징수하였는데, 발급 대상에 대한 신분 구별뿐 아니라 적패규칙 시행 과정에서 ‘관리하는 청국인/관리받는 청국인’의 양상이라는 재류 청국인 내부의 다층성을 보여주고 있다. 일본 측은 재류청국인의 자치조직인 회소·회관의 청국인 대표〔總代〕에게 적패규칙 운영 업무의 일부를 위임시켰으나, 이와는 별도로 단속 관리인으로서 청국인을 고용할 필요가 있었다. 청국 영사의 부재에 따라, 일본 측은 ‘적패규칙’을 통해 독자적인 청국인 관리제도를 시행하는 것이 가능하였으나, 운용을 위한 행정적 비용을 부담해야만 했으며 이를 해소하기 위해 자치조직을 이용하고자 한 것이다.This article examines the regulations for Chinese during the absence of the Chinese consulate in Japan, focusing on the capital city, Tokyo. Tokyo was Japan’s only ‘open city(開市)’ in the era of ‘foreign settlements’. Unlike ‘open ports(開港)’, foreigners has been allowed temporary residence for commercial activities only, and no foreign trade vessels have been allowed to enter the Tokyo. Thus, unlike other open ports, Tokyo was limited to develop into the trade port, and expand the foreign settlement as well. In spite of these limitations, there were many “foreign employees(お雇い外國人)” in Tokyo. The “foreign employees” were invited and hired to pursue the Japan’s modernization policy, and naturally gathered in Tokyo, the center of politics and diplomacy. This phenomenon can be seen in Chinese in Tokyo as well, who accounted for half of the foreign population in Japan at that time. Many of those who received a registration card(sekihai 籍牌) under the “regulations for Chinese (sekihai-kisoku 籍牌規則)” in Tokyo, were those employed by Mitsubishi. Interestingly, the number of registration cards issued to them was well above the actual number of Chinese in Tokyo at the time. This is because the Chinese hired by Mitsubishi were not actually reside in Tokyo, but worked on the Mitsubishi’s steamboats. It shows that the regulations for Chinese has been strictly enforced.
Regulations for Chinese are also showing the multi-layered of Chinese in Tokyo. The regulation divided Chinese into two status, upper and lower classes and collected different fees for them. At the same time, in the process of enforcing the regulations, Chinese are divided into managers and those who are subject to management. Due to the absence of the Chinese consulate, it was possible for Japan to implement its own system of managing the Chinese, but had to bear administrative costs for the implement of the regulations and to cooperate with the Chinese communities in Japan.
