사회기반시설의 적법한 설치·운영에 의해 재산상 손실이 발생한 경우에 손실보상이 고려될 수 있다. 그러나 소음·진동 등에 의한 침해행위는 고권적 법률행위가 아닐 뿐만 아니라 직접적이고 의도적인 재산권 침해가 아니라는 점에서 공용수용의 요건을 충족하기 어렵다. 이러한 사례와 관련하여 독일에서는 종전에 ‘수용적 침해이론’이 적용된 경우가 있으나, 이 이론은 그 법적 근거를 상실하여 설득력을 잃고 있다. 이러한 이론에 따라 유추적용에 의한 손실보상을 인정한 대법원 선례가 있으나 법률이 아닌 시행규칙(법규명령)에 근거하여 이러한 유추적용을 하는 것은 헌법 제23조 제3항의 ‘법률보상주의’에 반한다. 간접손실은 원칙적으로 공용수용에 대한 손실보상(수용보상)에 해당하지 아니한다. 이러한 문제는 입법적 해결이 가장 바람직하다. 이와 관련하여 독일 연방임미시온방지법 제42조에는 소극적 소음방지와 관련된 (조정적) 보상을 규정하고 있다. 관계 법령의 유추적용을 통해 토지보상법에 규정된 범위를 초과한 간접손실에 대해 손실보상이 인정된다고 하더라도 사회기반시설은 공익사업의 실현을 위해 설치되고 운영되는 것이므로 그 소송형식은 행정소송에 의하여야 한다. 손실보상청구에 대해서는 공법상 당사자소송을 제기할 수 있다. 재결전치주의를 반드시 강제할 이유는 없다. 토지보상법 제34조는 재결의 형식에 관한 규정일 뿐, 재결전치주의를 규정한 것은 아니다. 물론 지방토지수용위원회 또는 중앙토지수용위원회의 재결을 거친 경우에는 항고소송을 제기할 수도 있다. 사견으로는 무리한 법리의 적용이나 유추해석 등에 의해 손실보상을 인정하는 것보다는 손해배상의 방식으로 접근하는 것이 더 현실적이다. 공공기관이나 공공단체에 의해 사회기반시설이 설치·운영되는 경우에는 민법 제758조 제1항 및 환경정책기본법 제44조 제1항에 따라 손해배상을 청구할 수 있다. 다만 환경정책기본법 제44조 제1항에 따라 무과실책임이 인정되고 있지만, 이는 매우 포괄적인 규정이므로 제한적으로 해석하는 것이 타당하다.Compensation may be considered in case of property damage caused by lawful installation and operation of an infrastructure. However, it is difficult to satisfy the requirement of eminent domain for public use because the violation of noise, vibration, etc. neither falls within the scope of public power nor constitutes a direct and intentional infringement of property rights. In Germany, “quasi-expropriation infringement theory” is applied to these cases, but this theory has lost its legal basis in Germany. There is precedent of the Supreme Court of Korea admitting compensation by analogical application in accordance with the foregoing theory. However, applying such an analogy based on an enforcement rule (regulation), rather than a law, is contrary to the principle of legal compensation of Article 23 (3) of the Constitution of the Republic of Korea. Indirect loss, in principle, is not eligible for compensation for public eminent domain. The legislative method is the most desirable to solve this problem. In this respect, Article 42 of the German Federal Nuisance Prevention Act provides for adjustable compensation in relation to passive noise prevention. Even if compensation is recognized for indirect loss exceeding the range specified in the Act on Acqusition of and Compensation for Land, Etc. for Public Works Projects (hereinafter “Land Compensation Act”) through application of analogy of related laws and regulations, the form of the lawsuit must be based on administrative litigation because the social infrastructures are installed and operated for the realization of public service projects. It does not necessarily have to go through the adjudication first. Article 34 of the Land Compensation Act is a provision on the form of adjudication, but does not prescribe to go through the adjudication process first. However, an appeal may be filed against the adjudication of the Central Land Tribunal or a local Land Tribunal. It is more realistic to approach with a method of a claim for damages rather than to admit compensation by the application of unreasonable jurisprudence or analogy interpretation. If a social infrastructure is established and operated by a public institution or public organization, it may claim damages in accordance with Article 758 (1) of the Civil Act and Article 44 (1) of the Framework Act on Environmental Policy. While liability without fault under Article 44 (1) of the Framework Act on Environment Policy is recognized, but this is a very comprehensive provision, so it is reasonable to interpret it in a limited sense.
