日本における長時間労働の問題は、昔から指摘されてきた古くて新しい問題ではあるが、特に近年国内を中心に注目を浴びることになっているのは、おそらく例の電通の過労自殺事件 がそのきっかけになったと言える。
昨今進められている政府主導による法改正の1つは、目的規定に「労働生産性の向上」が規定されていることと、もう1つは「国の講ずべき措置」に「多様な就業形態の普及」が盛り込まれていることであろう。しかし、それが労働者側からすると懸念されるべき側面であると言わざるを得ない。手段と目的の順序が逆である、言わば本末転倒による弊害と危険性についても指摘した。本論文では、労働時間を取り巻く日本的な現状とその特徴について再確認した上で、長時間労働の是正と改革を取り巻く諸問題、疑問とその論点を整理し、長時間労働の発生要因とその日本的特徴、その是正のための現実的課題を模索したのである。
