조국 법무부장관의 사퇴 이후 검찰개혁에 대한 논의가 새로운 국면에 접어들었다. 정부-여당의 주도로 사법개혁법률안들(공수처법안, 형사소송법개정안, 검찰청법개정안)이 국회를 통과했지만, 논란은 계속되고 있다.
논란의 핵심은 검찰개혁의 당위성이 아니다. 조국 반대가 검찰개혁의 반대였던 것도 아니고, 조국이 물러났기 때문에 검찰개혁 또한 막을 내린 것도 아니다. 오히려 남은 과제는 진정으로 국민을 위한 검찰개혁이 무엇이며, 이를 위해 어떤 방향과 내용으로 검찰개혁이 진행되어야 하느냐에 대한 국민적 공감대의 형성 및 이에 기반한 정치적 합의일 것이다.
그동안 조국 장관의 임명과 함께 형사피의자가 법무부장관이 되어 검찰개혁을 주도하는 것이 정당한가를 둘러싸고, 국민적 갈등이 컸지만, 이제는 과연 검찰개혁의 내용이 진정 국민을 위한 개혁인지의 여부를 면밀하게 검토해 봐야 할 것이다. 명목은 개혁이지만, 그 내용은 오히려 개악인 경우도 적지 않기 때문이다.
특히 공수처법은 매우 심각한 문제를 안고 있다. 검찰이 더 이상 ‘정권의 시녀’ 노릇을 하지 않고 객관적이고 공정한 수사를 통해 국민의 인권에 기여할 수 있도록 하는 것이 목표가 되어야 하는데, 대통령의 인사권을 통해 공수처가 대통령의 새로운 수족이 될 우려가 매우 크기 때문이다. 그런 공수처라면 차라리 도입하지 않는 편이 낫다.
또한 공수처는 검사 25인 이내, 수사관 40인 이내의 슬림한 조직으로 설계되어 있는데, 담당하는 사건의 범위는 매우 방대하다. 검찰과 경찰은 관할권이 없고, 공수처는 인력이 부족한 상황에서 도대체 어느 기관이 그 사건들을 처리한다는 것인가. 나아가 검경수사권조정의 결과 여하에 따라 공수처의 역할 또한 달라져야 할 것인데, 이를 동시에 추진하는 것도 모순이다.
이런 여러 가지 문제점을 보완해서 진정으로 국민을 위한 공수처, 국민을 위한 검찰개혁이 될 수 있도록 해야 한다. 그리고 이런 문제들에 대한 근본적 해결을 위해서는 국가시스템의 개혁, 헌법개정까지도 다시 생각해 봐야 한다.With the resignation of Cho-Kuk, the Minister of Justice, the debate over prosecution reform has entered a new phase. Now, it is necessary to examine closely whether the contents of the prosecution reform are truly reforms for the people. For nominality is reformation, but the content is in many cases deformed.
In particular, the Independent Investigative Agency Act has serious problems. The goal of the prosecution reform should be to ensure that the prosecution is no longer the "maid of the regime," but contributes to the human rights of the people through objective and fair investigation. However, there is a high possibility that the Independent Investigative Agency will become a new limb of the president through the president's authority over human resources. It is better not to introduce such an organ.
In addition, the Independent Investigative Agency is designed to be a slim organization with less than 25 prosecutors and less than 40 investigators. But the range of cases in charge is vast. The prosecution and the police have no jurisdiction, and the agency has no manpower. What kind of organization handles the cases? Furthermore, the role of the agency's authorities should also vary according to the outcome of the adjustment of the prosecution and police investigation. It is also contradictory to push it at the same time.
It is necessary to make up for these problems so that they can be truly a public organ for the people and prosecution reform for the people. In order to fundamentally solve these problems, it is necessary to rethink national system reforms and constitutional revision.
