본 연구는 영국에서 ‘인종 및 종교적 혐오금지 법률(Racial and Religious Hatred Act 2006)’의 제정과정을 통해서 ‘신성모독의 현대화’의 정치적 과정을 분석하는 것을 그 목적으로 한다. 서구에서 종교에 대한 공격적이고 경멸적인 표현은 사회에 대한 공격으로 간주되었고 신성모독죄라는 형태로 처벌받아왔으나 세속주의 및 자유주의의 전개와 함께 신성모독에 대한 처벌은 시대착오적이라는 비판을 받게 되었다. 다른 한편, 다문화사회의 전개와 함께 소수자에 대한 존중 혹은 보호의 문제와 종교적 신념에 대한 보호의 불평등의 문제가 노출되면서 구래의 신성모독 죄의 확대적용 혹은 변형 요구가 높아졌다. 이들은 세속화 경향 속에서도 사회의 보호와 유지를 위해 국가가 종교와 타협 혹은 공존했던 역사를 다문화적 맥락 속에서 이를 재해석하고자 하였다. 이러한 다양한 시각들은 세속주의의 현대화 논의과정에서 뒤엉켜 표현되었으며 ‘인종 및 종교적 혐오금지 법률’의 제정과 뒤이은 신성모독죄의 폐지로 수렴되었다. 그러나 여전히 영국사회에서 표현의 자유와 소수자의 존중, 이 둘을 어떻게 조화시켜야 하는가에 대한 물음은 해결되지 못한 채 남아 있다.The aim of this study is to examine the establishment of the ‘Racial and Religious Hatred Act 2006’ in the UK in the historical and political context of the modernization of blasphemy law. While aggressive and contemptuous expressions against religions in the western society had been punished as blasphemy, the punishment was criticized for being anachronistic with the development of secularism and liberalism. On the other hand, as demands for more respect or protection for minorities and the inequality of protection for religious beliefs has increased with the development of a multicultural society, the desire for modernization of the old blasphemy law surged. Minority groups tried to reinterpret the history of the country’s compromise with religion or coexistence in a multicultural context in order to protect their ethnic and religious identities amid the surge of secularization. These various perspectives were entangled in the process of modernization of blasphemy and converged on the enactment of the “Racial and Religious Hatred Act 2006” with the following abolition of blasphemy law. It still remains unanswered, however, how to balance the freedom of expression and respect for minorities.
