‘거부처분의 처분성 인정요건으로서의 신청권 이론’은 지역주민의 도시계획 변경 신청과 관련하여 대법원 1984. 10. 23. 선고 84누227 판결에서 최초로 언급된 후로 적용영역을 폭넓게 확장한 판례 이론이다. 대법원 1998. 7. 10. 선고 96누14036 판결 이래로 대법원 판례는, 행정청의 어떤 거부행위가 항고소송의 대상이 되는 거부처분에 해당하기 위해서는 ① 그 신청한 행위가 공권력의 행사 또는 이에 준하는 행정작용이어야 하고, ② 그 거부행위가 신청인의 법률관계에 어떤 변동을 일으키는 것이어야 하며, ③ 그 국민에게 그 행위발동을 요구할 법규상 또는 조리상의 신청권이 있어야만 한다고 3가지 요건을 도식화하였다. 판례의 신청권 이론에 관해서는 이미 많은 선행연구가 이루어졌다. 본고는 판례 이론이 만들어진 배경 내지 여건들에 초점을 맞추어, 이제는 그 여건들이 변경·해소됨으로써 신청권 이론의 존립근거가 사려졌음을 규명하고자 하였다.
당초 신청권 이론은 도시계획결정 변경 신청 사례와 같이 관계 법령에 신청 제도가 규정되지 않았던 입법공백 사태에서 사법심사척도의 부재를 이유로 본안판단을 회피하기 위하여 개발된 특수이론일 뿐이지, 모든 거부처분에 대해 보편적으로 적용되는 일반이론이 아니었다. 그런데 대법원 84누227 판결은 이를 모든 거부처분에 관한 일반이론인 것처럼 판시하였고, 이후 관계 법령이나 행정규칙에 신청 제도가 규정되어 있는 사안에서도 법원이 본안판단을 회피하기 위한 손쉬운 방편으로서 신청권 이론이 남용되었다. 법원 내부적으로도 신청권 이론의 부정적 효과를 자각하여 일종의 출구전략을 모색하고 있다. 2000년대 이후로 관계 법령의 규정들을 적극적으로 해석하여 법규상 신청권을 인정하거나, 법의 일반원칙과 기본권 침해를 이유로 조리상 신청권을 인정하는 판결들이 여럿 나왔는데, 이는 신청권 이론의 틀 내에서 본안판단과 권리구제를 확대하려는 시도이다. 최근에는 신청권 이론에 의지하지 않고 행정소송법상 처분 개념 정의를 기준으로 처분성을 인정하여 본안판단을 하는 판결들이 늘어나고 있다. 그러나 여전히 신청권 이론에 의지하는 판결들도 나오고 있어 이론적 혼돈이 존재한다.
거부처분의 인정요건으로서 신청권을 요구하는 것은 현행 행정소송법의 처분 개념 정의 규정에 배치될 뿐만 아니라, 이론적으로도 특별히 존재할 실익이 없다. 처음 신청권 이론이 태동한 도시계획의 영역에서도 관련 법령이 정비·확충된 이후로는 대법원 판례가 계획변경신청권을 인정하여 본안심사를 하고 있으므로 대상적격을 부정함으로써 항고소송을 봉쇄하고자 한 당초 신청권 이론의 존재이유는 소멸하였다.
최근 대법원 판례들을 개관하면, 대법원 재판실무에서 신청권 이론의 문제점을 인식하여 가급적 그 적용을 자제하려는 의식적인 노력이 있음을 알 수 있으나, 아직은 대법원 판례에서 신청권 이론이 명시적으로 폐기된 상태가 아니다. 그렇다 보니 여전히 하급심에서 ‘법규상 또는 조리상 신청권이 인정되지 않는다.’는 이유로 처분성을 부정하는 소각하 판결이 나오고 있다.
신청권 이론은 선한 의도가 항상 좋은 결과를 보장하는 것은 아니라는 점을 일깨워주는 또 하나의 사례이다. 신청권 이론은 당초 부당한 청구를 배척하기 위한 선한 의도로 만들어졌고, 법원은 이를 널리 활용하여 손쉽게 본안심사를 회피함으로써 많은 편의를 누렸으나, 이는 거부처분 취소소송에서 법원이 제 역할을 못하고 사법불신을 초래하는 질곡으로 작용하고 있다. 1985. 10. 1.부터 개정된 행정소송법이 시행됨을 계기로 종래의 일본 판례를 답습하던 경향에서 진작 벗어났어야 마땅한 데 때를 놓쳤다. 이제라도 대법원 전원합의체에 의한 판례변경을 통해서 신청권 이론을 명시적으로 폐기하는 것이 필요하다. 설령 신청권 이론을 완전히 폐기하지는 않는다고 하더라도, 관계 법령에 행정권한발동의 요건이나 기준에 관한 구체적인 기준이 전혀 없는 예외적인 사안에서 제한적으로 적용하는 것이 바람직하다.
그러나 국민의 어떠한 내용의 신청에 대한 행정청의 거부가 언제나 거부처분에 해당하는 것은 아니다. 그것이 거부처분인지는 행정소송법에서 정한 처분의 개념 정의에 따라 판단하여야 한다. 그리고 처분성 인정이 원고의 청구 인용이라는 결론을 시사하는 것이 결코 아니다. 처분성 인정 여부는 소송요건 단계에서 심사할 사항이고, 처분의 위법 여부는 본안에서 심사할 사항이다. 양자를 엄밀하게 구분하지 않은 채 뭉뚱그려 판단하려고 하는 것이 진정한 문제의 원인이다. 행정작용에 관한 규범의 규율밀도가 낮다면 그만큼 행정청에 행정작용 형성 재량이 넓은 것으로 보아 행정청의 판단을 존중하여야 하는 것이지 처분성 자체를 부정하는 것은 타당하지 않다.The scope of the application of the theory of the right of application with regard to residents’ application for urban planning has been broadened since the pronouncement of the Supreme Court Decision 84Nu227 Decided October 23, 1984. Ever since the rendition of the Supreme Court Decision 96Nu14036 Decided July 10, 1998, the Supreme Court has formulated three requirements as necessary for any act of refusal by the administrative authority to constitute a refusal disposition that may be subject to an appeal, which are as follows: (i) the act in question must constitute the exercise of public power or administrative action that corresponds thereto; (ii) the act of refusal by the administrative authority must be the one that causes a change in the applicant’s legal rights; and (iii) the applicant must have the right to apply for the implementation of the administrative action in question under laws and regulations. This paper focuses on the background and conditions leading up to the formulation of such requirements by precedents and attempts to prove that the basis of the theory of the right of application has disappeared upon the change and dissolution of such conditions.
The view that an applicant must have the right of application for a refusal disposition to be deemed valid is not only against the definition provision of the concept of disposition of the current Administrative Litigation Act but also has no practical benefit from the theoretical perspective. Ever since relevant laws have been overhauled and expanded, the Supreme Court has recognized the right of application for change in urban planning, and a review on merits has been conducted accordingly, thus nullifying the grounds for existence of the theory of the right of application that intended to block administrative litigation by denying the standing to sue.
Not all refusals by the administrative authority always constitute a refusal disposition, and whether a certain refusal constitutes a refusal disposition must be determined in accordance with the definition of the concept of disposition under the Administrative Litigation Act. Also, recognition of the dispositive nature of a certain refusal by the administrative authority by no means implies the acceptance of the plaintiff’s claim. Whether to recognize the dispositive nature must be examined in the procedure for review of the requirement of lawsuit, and whether a certain disposition is illegal is a matter to be examined in the case on the merits. If regulations for administrative action are not imperative enough, that means the administrative authority is vested with a broad discretion; the administrative authority’s decision should thus be respected, and denying the dispositive nature itself is unreasonable.
