특허권에 대한 침해는 특허발명의 실시자가 특허권자나 전용실시권자로부터 정당한 실시허락을 받지 아니하고 임의로 특허발명과 동일 또는 균등하거나 혹은 이용관계에 있는 발명을 업으로써 실시하는 것으로 정의할 수 있다. 특허침해는 실시자가 특허발명의 모든 구성요소 및 그 유기적 결합관계를 실시하여야 성립하므로(구성요소완비의 원칙, All Elements Rule), 실시자가 복수이고 그들이 각별로 구성을 나누어 실시하는 경우에 그 복수의 행위자를 ‘하나의 실시주체’로 보아 구성요소완비 여부를 판단할 수 있을지 문제가 된다. 이러한 문제는 특히 시스템 특허나 BM 특허에서 많이 문제 될 수 있다. 이것은 복수주체의 공동 특허침해 성부 문제이다.
협의의 복수주체 특허침해는 일방이 타방을 지배·관리하는 경우(지배관리유형) 뿐만 아니라, 복수 행위자가 실시의사를 공유하여 하나의 특허발명을 나누어 실시하는 경우(공동실시유형)에 성립한다. 이러한 주관적 공동설적 입장은 도구이론과 함께 일본의 유력한 실무의 입장이기도 하고 미국에서도 Akamai Ⅴ 판결을 통해 판례법으로 명확히 확립되었다. 또한 넓은 의미의 복수주체 특허침해는 수인이 각별로 다른 실시행위를 하여 공동불법행위 요건을 충족하는 경우는 물론 직접침해자와 간접침해자 사이 또는 회사와 대표이사 사이에서도 성립할 수 있다. 그리고 복수주체가 하나의 주체로 평가되어 공동의 특허침해가 인정되는 경우, 특허법 제128조 제2항 내지 제7항에 의한 손해액 추정 규정에 따라 손해액을 산정함에 있어서는 각 복수주체에 대한 모든 요소가 해당 규정의 손해액 산정 요소로 이용될 수 있다. 또한 그 복수의 침해자들은 공동 불법행위자로서 부진정연대채무를 진다.
한편 특허법 제128조 제8항의 ‘고의적인 침해’는 고의에 의한 침해 및 고의와 유사한 정도로 높은 비난가능성을 가진 중과실에 의한 침해를 포함하는 것으로 봄이 타당하다. 다만 그와 같은 주관적 요소에 의한 가중배상은 개별 행위태양에 따라 징벌적인 책임가중의 의미를 가지고 있으므로, 그러한 고의적인 침해를 한 공동 특허침해자에 대해서만 손해배상액을 가중하여야 하고, 다른 가담자는 원래 산정된 손해액에 대해서만 연대하여 배상할 책임이 있다. 그리고 해외에서 특허발명을 실시한 경우 침해가 성립된다는 규정을 가지고 있지 않고 ‘수출’을 실시행위의 태양에서 배제한 우리 법제에서는, 해외에서 판매된 일실이익에 대해서는 원칙적으로 특허법 제128조 제2항을 적용하여 손해를 산정할 수 없고, 예외적으로 침해가 성립될 수 있는 경우에 특허법 제128조 제4항이나 제5항, 제7항에 따른 손해액이 인정될 수 있다.Patent infringement is defined as "when an accused infringer practices or uses the patented invention, or the equivalents, for business purpose without permission from the patent holder or the exclusive licensee." Under the All Elements Rule, a patent infringement occurs only where every element of the patented invention, or its substantial equivalent, is present in the accused product or process. An issue—whether plural accusers would meet the All Elements Rule as ‘one actor’—may arise when they divided their roles in the infringement. The problem like this may often occur in the claims related to system patent or BM patent. This issue is called "Divided Infringement" or "Joint Infringement.“
In a limited sense of the term, divided infringement occurs not only where one actor directs or controls other’s performance to practice the invention ("Direct or Control Type") but also where multiple actors share a common purpose and divide their roles to use the invention ("Joint Infringement Type"). This theory, along with the tool theory, is popular in Japan and has also been confirmed in the U.S. as a common law through the U.S. Supreme Court’s Akamai V decision. In a broader sense, divided infringement contains the joint tort type of infringement where each accuser practices separate acts that would constitute all the elements of the patent claim and shares objective co-relationship. This type of divided infringement could also be found between a direct infringer and an indirect infringer as well as between a firm and its executive. Where the divided infringement is found, every factors in all of each participants in the infringement may be used to calculate the damage according to the Patent Act §128(2) ~ §128(7). In this case, each infringer will be liable for the whole damage as a joint tortfeasor liability.
For the cases subjected to the Patent Act §128(8), this provision will apply to not only intentional infringement but also gross negligence infringement with similar culpability. However, only the infringer with the subjective factor will be liable for the enhanced damage because this provision has been enacted as a punitive tool against the willful behavior of the individual infringer. Therefore, the participant without the subjective culpability will only be liable for the compensatory damage within the full enhanced damage.
For the foreign practices cases, there is no provision to apply under the Korean Patent Act. And the Act does not define ‘export’ as a type of patent practice. Thus, the lost profit by a foreign sale cannot not be compensated in general, but can only be covered by the Patent Act §128(4), (5), or (7).
