환경범죄는 피해의 간접성, 전파성, 완만성, 상규성, 지속성 등 일반 범죄와 다른 특성이 있다. 또 단속인력 부족 등으로 위반행위가 제대로 드러나지 않는 숨은 범죄의 건수가 많다. 따라서 행정관청의 단속 빈도가 범죄 증가 여부를 좌우하는 경향이 있다. 또 적발되어 수사기관에 고발된다고 하더라도 고의를 입증할 증거가 부족하다는 등의 사유로 불기소로 종결되는 등 처벌되지 않는 비율도 높은 편이다. 그러므로 형법상 범죄와 비교할 때 위법행위를 저지르더라도 사실상 이에 상응한 처벌이 제대로 이루어지지 않고 있는 실정이다.
이러한 이유로 끊임없이 일어나고 있는 환경범죄에 제대로 대응하기 위해서는 사업체에서 발생하는 오염물질이 대기나 수질 등에 미치는 영향을 실시간으로 측정할 수 있는 시스템을 갖추고 철저한 현장점검으로 위법 여부를 확인해야 한다. 이와 더불어 불법행위에 대해서는 엄하게 처벌하고 위법행위로 취득한 이익을 철저히 환수하는 것도 중요하다. 특히 형사적 측면에서 엄격한 법집행을 위해서는 환경형법의 특성을 고려하여 불기소 비율이 높은 범죄 유형에 대한 전면적인 정비가 필요하다. 현행 대부분의 환경관계법에서는 중과실·업무상 과실 등에 한정하여 예외적으로 과실범을 처벌하나 환경범죄의 특수성을 고려하여 단순 과실범에 대한 처벌조항 신설이 필요하다. 동시에 환경침해행위에 대한 결과를 입증하는 유형의 처벌조항과 함께 환경침해가 예견되는 일정 수준 이상의 오염물질 배출행위가 존재하기만 하여도 처벌하는 방식 등 사전 예방적 대책마련도 필요하다. 이 경우 죄형법정주의 원칙에 저촉되지 않도록 유의해야 한다. 무엇보다 여러 환경관계법에 처벌규정이 있으나 그 처벌 정도가 벌금 등에 불과하여 범죄예방에 큰 도움이 되지 않으며, 환경범죄단속법에서는 특정 환경범죄를 가중처벌하고 있으나 실제 적용 가능한 범죄대상이 한정되어 처벌 사례는 매우 드물다. 또한 가중처벌이라고 하지만 여전히 법정형이 낮고, 특히 벌금형의 경우 불법수익의 규모를 고려하지 않고 일률적으로 규정하여 개선이 필요하다. 그리고 반복적인 환경범죄에 대해서도 개별 환경관계법의 형량이 낮아 처벌이 미약하므로 환경범죄단속법의 누범가중규정을 재정비하여 가중처벌하고, 양벌규정을 개정하여 법인 등에 대한 벌금형의 법정형을 대폭 상향하여 범죄 억지력을 높여야 한다.Environmental crimes are characterized by difficulties in identifying direct damage as well as the slow, but lasting impact of the damage. Therefore, even if a person commits an offence, the corresponding punishment is not being carried out properly.
For this reason, it is necessary to properly respond to the constant occurrence of environmental crimes. First of all, a system that can measure the impact of pollutants generated by businesses on air or water in real time should be systematically managed and supervised, and thorough on-site inspections should be conducted to check whether they are illegal. In addition, the government should criminally punish illegal activities and thoroughly recover profits acquired from illegal activities. For strict enforcement of criminal law, it is necessary to newly establish a penal provision for negligence in view of the distinctive nature of environmental crimes.
Although various environmental laws have various punishment regulations, punishment is not a threat because it often is limited only to a fine. The Environmental Offenses Control Act imposes a heavier punishment on certain environmental crimes, but it is very rare to be punished under the current the Environmental Offenses Control Act due to the limited scope of actual crimes that are subject to punishment. Also, although it is called aggravated punishment, legal penalty is still not severe enough. In particular, there is a necessity for improving the sentence of fines, which imposes uniform statutory punishment without regard to the size of illegal profits. Above all, repeated environmental crimes, on which the amount of a fine imposed is small, ought to be punished with aggravated punishment, and joint penal provisions need to be revised in a way that increases the penalty amount to deter any further crimes being committed.
