자유형과 같은 전통적 형벌을 가지고는 조직범죄로 대표되는 이른바 현대형 범죄에 대하여 효과적으로 대처하는 것이 어렵다는 공감대가 형성되었다. 즉, 현대형 범죄는 대부분 이욕(利慾)적 동기에 터 잡고 있고, 이러한 범죄를 통해 범인이 얻는 막대한 불법수익을 박탈하지 아니하는 한 효과적인 범죄 대처는 어렵다는 것이다. 이러한 불법수익 박탈의 방편 중 하나로 몰수가 주목을 받아왔다. 정부나 국회도 이러한 점을 주목하여 종래 형법상 몰수의 부가형적 성질을 삭제하여 몰수의 보안처분적 성질을 강조하는 한편, 검사의 공소제기와도 결부되지 아니한 이른바 독립몰수를 도입하려는 시도를 해왔다. 그러나 이러한 시도는 모두 불발되었고, 다만 몰수 관련 특별법에서 범죄수익 추정규정을 두고, 필요적 몰수 규정을 두는 등의 입법적 개선이 이루어졌을 뿐이다.
그런데 최근 n번방 사건을 기점으로 몰수제도 개선에 대한 사회의 목소리가 고조되었고, 입법자 역시 이러한 사회의 목소리에 반응하여 특히 공소제기와 결부되지 아니한 독립몰수의 도입을 내용으로 하는 개정안을 수차례 쏟아낸 바가 있다. 개정안들 중 일부는 제20대 국회의 회기만료로 폐기되었으나 제21대 국회에서도 이러한 입법적 움직임은 계속되고 있는 것으로 보인다. 이러한 상황에서 이 글은 각 개정안에서 도입하고자 하는 독립몰수 제도의 바람직한 모습을 규명해 보고자 한다.There was a widespread acceptance that it was very difficult to handle so-called modern crimes with traditional punishments such as imprisonment. In other words, a vast majority of modern crimes are motivated by profit seeking, and so effective crime handling is difficult unless we deprive the offender of the enormous economic proceeds of the crime. As an efficient measure of deprivation of economic proceeds of the crime, confiscation has been in the spotlight. The government and the National Assembly have also taken account of this and emphasized the nature of the confiscation as security measures, and have been attempting to introduce the so-called independent confiscation, which is not related to prosecution. However, all these attempts failed, and the only legislative improvements were made, such as the establishment of mandatory confiscation and the presumption of criminal proceeds under the Special Act on confiscation.
However, since the recent "n incident" (chatroom sex abuse case in Korea), the voices for the improvement of the confiscation system have been raised, and some legislators have also repeatedly proposed law amendment to introduce non-conviction-based confiscation. Some of the amendments were scrapped due to the expiration of the 20th National Assembly’s term, but the legislative move seems to be continuing in the 21st National Assembly. Under these circumstances, this article seeks to identify the desirable form of the non-conviction-based confiscation.
