반려동물과 함께 살아가는 사람들이 늘어남에 따라 반려동물로 인한 이웃 간의 갈등도 많아질 수밖에 없다. 대법원 2016. 1. 28. 선고 2014도2477 판결은 개에 의한 침해가 이루어진 사례를 다룬 최초의 대법원 형사판결이다. 위 판결에서는 두 가지 쟁점이 다루어졌다. 첫째는 자신의 진돗개를 공격하는 피해견을 피고인이 기계톱으로 죽인 행위 자체로 동물보호법 제8조 제1항 제1호를 충족하는지, 만약 그 행위를 정당화할 만한 사정이 있으면 구성요건 해당성이 조각되는지 여부이고, 둘째는 피고인의 이러한 행위가 긴급피난에 해당하는지 여부이다. 첫 번째 쟁점과 관련하여 위 판결은, 동물보호법 제8조 제1항 제1호가 제4호와 달리 ‘정당한 사유 없이’를 구성요건 요소로 규정하지 않으므로 ‘동물을 잔인하게 죽이는 행위’만으로 구성요건을 충족한다고 하였다. 이러한 결론은 문리해석에 비추어 보더라도, 또한 비교법적으로 독일의 동물보호법 제17조 제1항의 해석론을 참조하더라도 타당한 해석이다. 두 번째 쟁점과 관련하여 위 판결은, 개에 의한 침해는 사람에 의한 침해가 아니므로 정당방위가 문제 되지 않고 긴급피난만이 문제 된다는 전제에 서 있다. 이는 통설의 견해이기도 한데, 최근에 이에 대하여 반대하는 견해도 대두되고 있다. 동물의 공격으로 인한 위법성을 동물의 행위규범 위반으로 평가할 수 없다는 통설의 논거는 일응 타당하다. 그런데 정당방위의 부당한 침해에는 고의행위뿐만 아니라 과실행위도 포함되고 형법상 구성요건 해당성은 없으나 민법상 불법에 해당하는 경우에도 부당한 침해에 해당한다고 다수설은 말하기도 한다. 한편 민법 제759조 제1항은 동물의 점유자가 보관상 주의의무를 다하지 못하면 그 동물이 타인에게 가한 손해를 배상하도록 하고 있는바, 위 규정이 상정하는 면책사유를 인정할 수 있는 사례란 실제로 거의 없다. 그 결과 동물이 공격하는 상황이라면 그 동물의 점유자가 있는 이상 민법상 불법에 해당하여 형법상으로도 피공격자에게 정당방위가 인정될 개연성이 매우 높다. 즉 동물이 공격하는 경우에도 정당방위 상황이 도래할 수 있다. 이러한 측면에서 개에 의한 침해의 경우 긴급피난만이 문제 된다는 대상판결의 전제에는 수긍할 수 없다.An increasing number of individuals living with a companion animal naturally lead to growing number of conflicts between neighbors. Supreme Court Decision 2014Do2477 decided January 28, 2016 (hereinafter "subject precedent") is the Supreme Court’s first-ever criminal ruling that addressed violation caused by a dog.
Two key issues dealt with in the foregoing subject precedent are: (i) whether the Defendant’s act per se in using a power saw to kill the victimized dog of this case that had been attacking the Defendant’s jindoggae (a Korean breed of hunting dog) satisfies Article 8(1)1 of the Animal Protection Act and, if there exist circumstances justifying such act, whether it extinguishes the applicability of constituent elements; and (ii) whether the Defendant’s act constitutes emergency evacuation.
With respect to (i), Supreme Court Decision 2014Do2477, supra, reasoned that Article 8(1)1 of the Animal Protection Act, unlike Subparagraph 4 of the same Article thereof, does not prescribe "without a justifiable ground" as a constituent element, and thus the "act of cruelly killing an animal" alone satisfies the constituent element. Such conclusion is tenable even if viewed from a literal construction, not to mention construed from a comparative legal standpoint in reference to the interpretative theory of Article 17(1) of the Germany’s Animal Protection Act. Concerning (ii), the subject precedent is premised on the fact that emergency evacuation, not self-defense, is the sole issue, inasmuch as a violation caused by a dog is not a violation committed by a human being. This is also a generally accepted perception but counter views have been recently materializing.
The general rationale that illegality arising from an animal attack cannot be deemed as such animal’s violation of the code of conduct is a prima facie standard of reasonableness. However, existing majority theories claim that an unlawful violation of the right of self-defense encompasses an intentional as well as a negligent act and that applicability of constituent elements is nonexistent under the Criminal Act but that a tort under the Civil Act may constitute unlawful violation.
Meanwhile, Article 759(1) of the Civil Act provides for an animal owner, if failing to fully perform the duty of care of a good manager, to compensate for damages that his/her animal inflicted on another. That said, case studies acknowledging the grounds for exemption referred to in the above provision are next to none. Consequentially, if there is an animal attack and insofar as that animal has an owner, such act constitutes tort under the Civil Act. Accordingly, from a criminal law perspective, the probability of the attacked party’s self-defense being recognized is very high. In short, self-defense circumstances may arise even in cases of an animal-related attack.
Considering the above, the author does not consent with the subject precedent’s premise that only emergency evacuation is at issue in instances of a violation caused by a dog.
