의료과오소송의 주요 연구대상은 아니나, 자신에게 발생한 실제 손해에 부합하는 정당한 손해의 산정은 피해자에게 가해자의 과실과 인과관계의 증명 못지않은 중요 문제이다. 최근 대법원은 일실이익 산정과 관련하여 일반육체노동을 하는 사람의 가동연한에 대한 경험칙을 만 65세로 변경하였는데, 우리나라의 사회·경제적 구조, 생활여건의 급속한 변화, 법제도의 정비 등을 고려하면 기존의 경험칙으로 여겨지던 만 60세의 가동연한을 계속해서 유지하는 것은 손해배상의 이상에 부합하지 않는 과소배상을 만들어 낸다는 문제점에서 시작된 것으로 이해할 수 있다. 과소배상과 더불어 과다배상 역시 손해배상에서 경계되어야 하며, 동일 사안을 두고 다른 일실이익이 산정되어 예측가능성이 없는 상태가 계속되는 것도 이제는 지양되어야 한다. 도시일용노동자의 가동일수에 대한 경험칙과 노동능력상실률 산정에 기준으로 작용해온 맥브라이드 방식의 한계는 인내하기 어려운 문제를 야기하고 있다. 우리 사회의 노동구조와 소득의 변화 흐름에서 임금노동자들이 실제 얻는 월 소득과 경험칙으로 인정되고 있는 가동일수를 통해 도출된 월 소득의 간극은 계속해서 벌어지며 과대배상의 문제를 야기하고 있다. 수십 년 동안 노동능력상실의 정도를 산정함에 중추적 역할을 담당해온 맥브라이드 방식의 한계점은 이를 보완하기 위한 여러 노력에도 불구하고 많은 국면에서 해결책이 없는 문제를 일으키고 있다. 가동일수에 대한 경험칙은 더 이상 유지될 수 없고, 실제를 반영하여 단축되어야 한다. 노동능력상실률 산정에서도 맥브라이드 방식의 이용은 지양하고 그 장점을 수용하면서 현대의 의학 수준과 직업구조를 반영하여 마련된 대안을 기준으로 이용하여야 한다.
Although it is not the main subject of research on medical malpractice lawsuit, the estimation of legitimate damages that correspond to the actual damages done is as important to the plaintiff as the proof of the defendant’s negligence and causality to the plaintiff. Recently, the Supreme Court of Korea rivised the empirical rule concerning the retirement age of common labours to 65. Considering Korea’s rapid changes in socioeconomic structure and living conditions and reorganization of the legal system, maintaining the existing empirical rule may lead to undercompensation that does not meet intended purpose of compensation for damages. In addition to undercompensation, overcompensation should also be refrained from, and different results should be avoided in cases involving the same conditions. The limitations of the McBride method, which has served as the basis for estimating the loss of earning capacity and the empirical rule for retirement age of common labours, are causing problems that are difficult to ignore. In conclusion, the empirical rule for the number of working days can no longer be maintained and must be overruled to reflect the reality of our society. This article presents some statistics to supplement this opinion. In estimating the loss of earning capacity, the use of the McBride method should be avoided, and only advantages thereof may be inherited by the alternative methods, which reflect the modern medical knowledge and various occupations in advanced industrial structure.
